탐정업은 다양한 민간조사업 영역 중에서 실종자·가출인 등 ‘사람 찾기’, 각종 피해회복을 위한 ‘자료수집’ 등과 같이 국민들의 다양한 권익보호를 위하여 다른 사람의 의뢰를 받아 관련자료 및 정보 수집을 대행하는 서비스업이다.

 

탐정업은 개인뿐만 아니라 기업, 공공단체, 국가기관 등 다양한 분야에서 필요로 하고 있고, 세계 주요국가에서 주목을 받는 직업으로 각광을 받고 있다.

 

하지만, 우리나라에서는 그동안 탐정업에 대한 국민적 공감대와 수요가 높았음에도 불구하고, 법과 제도의 미비로 탐정업이 합법적인 직업으로 정착되지 못하고 있었다. 실제, 경찰청이 2017년 4월 실시한 공인탐정제 도입에 대한 여론조사 결과, 전체 응답자 중 72.3%가 탐정 법제화에 찬성을 했다.

 

지난 15여 년 간 탐정업 도입을 위한 법제화 노력이 있었지만, 탐정업의 지도․감독기관을 어디로 할 것인가 하는 관할권 문제 때문에 번번이 국회 입법 과정에서 무산되고 말았다. 이러는 사이에 ‘심부름센터’, ‘사실 확인 대행’ 같은 음성적 민간조사업이 성행하게 되었고, 부도덕한 의뢰나 과도한 성과에 집착한 나머지 불법적이고 부당한 조사가 끊이지 않았다.

 

탐정업 제도는 OECD 가입국 중 우리나라에만 없는 제도로 대다수의 선진국에서는 탐정 활동이 합법적으로 이루어지고 있다. 미국의 경우 15개 주(州)에서는 경찰, 1개 주에서는 법무부, 21개 주에서는 별도 전담부서에서 공인 탐정을 관리 중이고, 영국과 프랑스는 내무부, 스페인은 경찰, 일본은 공안위원회 등에서 공인 탐정을 관리·감독하고 있다. 우리나라도 조사서비스의 수요가 폭발적으로 증가하고 있지만 경찰력만으로는 그 수요를 감당할 수 없는 실정이다.

 

다행스럽게도, 문재인 대통령은 대선 당시 ‘사실 조사를 지원하는 공인탐정제도 도입 추진’을 공약한 바 있다. 현재 정부에서도 국정과제로 추진 중(2017.5)이며, 이에 발맞추어 도입계획까지 밝히고 있다. 현재, 국무조정실을 주축으로 법무부와 경찰청 실무자들의 논의가 진행되고 있고, 관리·감독기구 관할 부처 등을 지정해 내년 상반기까지 공인탐정법 제정을 추진한다는 계획이다.

 

금번 윤재옥 의원이 발의한 ‘탐정업의 관리에 관한 법률’은 우리나라도 세계 주요 국가들과 같이 적정한 관리를 통해 국민들이 탐정업 서비스를 믿고 이용하면서도 부작용은 방지할 수 있는 제도시행을 목표로 하고 있다. 이를 위해 탐정에 대한 국가자격제도, 탐정업에 관한 관리․감독 및 불법행위에 대한 처벌규정 등을 마련하는 내용을 담고 있다.

 

본 제정안을 대표발의한 국민의힘 윤재옥 의원은 “탐정업 법제화는 일자리 창출이라는 現정부의 핵심전략으로, 빠른시일 내에 국무조정실 주재 하에 경찰청과 법무부가 관리감독의 주체를 조정해야 한다.”고 촉구하고, “우리나라도 탐정업을 금지할 것이 아니라 세계 주요국가들과 같이 적정한 관리를 통해 국민들이 탐정서비스를 믿고 이용할 수 있도록 해야 한다.”고 법제정 취지를 밝혔다.

 

아울러 윤 의원은“탐정업의 관리에 관한 법률 제정을 통해 우리 국민들의 사생활과 권익을 보호할 수 있는 실효성 있는 정책이 마련되기를 기대한다.”며 법률이 조속히 제정될 수 있도록 국민들의 관심과 호응을 당부했다.
