【브레이크뉴스 경북 안동】이성현 기자=국민의힘 김형동 의원(경북 안동·예천)은 지난 18일 새해 첫 법안으로, 대마의 법적인 제약을 완화하여 합법적으로 대마를 의료 및 산업용 제품으로 활용할 수 있도록 하는 ‘마약류 관리에 관한 법률’일부개정안을 대표발의했다고 19일 밝혔다.

지난해 7월 안동이 ‘산업용 헴프 규제자유특구’로 지정되어 의료제품용 대마(헴프)를 생산, 가공, 판매할 수 있는 길이 열렸다. 그러나, 현행법에 따라 대마 전체가 마약류로 정의되다 보니 “법적인 근거가 없어 사업 자체가 불안정하다”거나 “특구 자체가 연장되지 않으면 대마산업이 좌초하는 것 아니냐”는 우려가 제기돼 왔다.

 

우리나라 현행법은‘대마’를 대마초와 그 수지(樹脂), 대마초 또는 그 수지를 원료로 하여 제조된 모든 제품 등을 말하며, 마약류로 분류하고 있다.

 

그러나 일반적으로 대마라고 뭉뚱그려 알려진‘헴프(Hemp)’는 환각성 약물이 배제되어 활용 및 유통되는 물질을 의미한다. 대마줄기 껍질(섬유·삼베), 씨앗(헴프씨드) 또는 기름(헴프씨드오일) 그리고 대마속대(건축자재) 등이 바로 그것이다.

 

해외에서도 대마 식물 재료의 총 중량 대비 건조중량 기준으로 THC(테트라하이드로칸나비놀) 함유량이 0.3% 미만인 것은 ‘헴프’로 정의하고 마약으로 분류하지 않는다.

 

이에 김형동 의원은 미국 기준에 맞춰 대마의 성분 중 환각성분(THC)의 함유량이 0.3% 미만인 것은 마약류에서 제외하고, 환각성분이 배제된 대마는 의료용·산업용으로 활용할 수 있도록 하는 내용을 담은 ‘마약류 관리에 관한 법률’ 일부개정법률안을 발의했다.

 

김 의원은 이번 법안 마련에 대해“이미 국내외에서 마약으로 분류하기 어렵다는 전문가들의 의견이 대세인데도 관련 법령이 현실을 반영하지 못한 점은 문제”라며, “합법화하는 대신 담배나 인삼처럼 공적인 기관에서 취급하는 방안을 마련하고 대마의 재배부터 가공, 판매까지 가장 엄격한 관리시스템을 갖춰야 할 것”이라고 말했다.

 

김 의원의 얘기처럼 지난해 12월2일 UN 산하 마약위원회는 대마를 마약류에서 제외한 것으로 알려졌다. 관련 보도에 따르면 이는 △대마가 수면장애, 통증, 다발성경화증, 뇌전증, 경련, 항암치료로 인한 메스꺼움 및 두통 등의 질병 치료에 크게 유효하고 △의료용 대마는 중독·의존성도 나타내지 않으며 △이에 따라 대마를 마약류에서 제외하라고 하는 세계보건기구(WHO)의 권고에 따른 것이었다.

 

그 밖에도 지난해 12월4일에는 미국 연방하원이 대마초 합법화 법률을 통과시켰고, 캐나다를 비롯한 전 세계 50개국 이상의 나라가 이미 의료용 대마의 사용을 합법적으로 허용하고 있다.
