경북도에 따르면 지난 15일 BTJ열방센터 관계자 두명이 역학조사 방해혐의로 구속되는 등 열방센터의 집합금지명령 위반, 진단검사 거부 등의 감염병예방법 위반행위가 지속되고 있어 더 이상 국민 건강을 위협하는 현 상황을 두고 볼 수 없다고 밝혔다.

이에 소재지 지방자치단체장인 상주시장이 그 동안의 위법사항 등에 대한 검토 후 법인취소 요청이 있는 경우, 청문 등 적법한 행정절차를 거쳐 법인설립허가 취소여부를 종합적으로 판단한다는 방침이다.

다만, 열방센터에 대한 수사 및 역학조사가 아직도 진행중인 만큼 법인설립허가 취소 절차 등은 장기화 될 수 있다.

민법 제38조에 의하면 법인이 목적 이외의 사업을 하거나 설립허가의 조건에 위반하거나 기타 공익을 해하는 행위를 한 때에는 주무관청은 그 허가를 취소할 수 있다.

이철우 경상북도지사는“도민의 생명과 안전을 위협하는 행위에 대해 그 어떤 예외도 있을 수 없으며, 방역방해 행위에 대해 법인설립허가 취소를 비롯한 모든 방법을 통해 끝까지 책임을 묻겠다.”고 밝혔다.
