Rep. Kim Jeong-jae, representative of the Domestic Violence and Child Abuse Prevention Act

Power of the People National Assembly member Kim Jeong-jae (Pohang Buk-gu) proposed a bill to prevent secondary violence against domestic and children on the 10th.

The bills proposed by Rep. Kim are the ‘Partial Amendment of the Act on Special Cases concerning the Punishment of Domestic Violence Crimes’ and the ‘Partial Amendment of the Act on Special Cases concerning the Punishment of Violence Against Children’.

According to Rep. Kim, under the current law, if there is a risk of a secondary perpetrator of domestic violence or child abuse, the perpetrator can be quarantined or banned from access through ‘emergency interim measures’ or ‘temporary measures’.

Temporary measures have to wait for a long time until the prosecution and the court decide, but in the case of emergency interim measures, judicial police officers dispatched to the scene can take ex officio or at the request of the victim.

The problem is that, unlike the temporary measures that are punished by imprisonment and fines for violations, in case of violating emergency temporary measures, a fine of not more than 3 million won for domestic violence and not more than 10 million won for child abuse.

In response, Rep. Kim Jung-jae proposed an amendment that imposes imprisonment with labor for not more than one year or a fine of not more than 10 million won for domestic violence, and imprisonment for not more than two years or a fine of 20 million won for child abuse.

In fact, even if the perpetrator of domestic or child violence violates emergency interim measures, the police officer dispatched to the scene cannot take active measures such as arresting the perpetrator because there is no basis for punishment.

Rep. Kim Jung-jae said, "The provision of fines for violators of emergency interim measures can give the perpetrators the perception that they will not be punished even if they violate them, so there is a risk of secondary harm until the court's interim measures are finalized."

If the amendments proposed by Rep. Kim are passed, violations of emergency interim measures will result in punishment equivalent to violations of interim measures for both domestic violence and child abuse.

Rep. Kim Jung-jae said, "I hope that the amendment will minimize the gap in victim protection." He said, "I will take the lead in improving the protection system for victims of domestic violence and child abuse."
