23일 대구고법 형사1부(부장판사 정성욱)는 공직선거법 위반 혐의로 기소된 경산시의원 A씨에 대한 항소심에서 검사의 항소를 기각하고 원심과 같이 벌금 70만원을 선고했다. 이에 따라 A씨는 직을 유지하게 됐다.

A씨는 지난해 4월 경산의 한 경로당에서 선거구민을 대상으로 최경환 후보의 선거 운동을 하는 과정에서 '국민의힘' 정당 명칭이 기재된 복당 관련 인쇄물 13부를 배부한 혐의로 기소됐다.

이에 대해 재판부는 “피고인은 공정한 경쟁을 보장하고자 하는 공직선거법을 훼손한 것으로 죄책이 가볍지않다”며 “다만 범행을 인정하고 잘못을 뉘우치고 있고 확정적인 고의로 범행을 저지른 것으로 보이지 않은 점, 시의원으로 재직하며 주민 복지와 지역 발전을 위해 힘쓴 점 등을 고려했다”고 밝혔다.
