이번 개정안은 도로교통법 제2조 제26호 ‘운전’ 정의 조항에 행정처분 관련 내용을 명확히 포함시키고, 도로 외 장소에서의 음주·약물·난폭운전에 대해서도 면허 취소나 정지 등 행정처분이 가능하도록 했다.
법안이 통과되면, 앞으로 아파트 주차장이나 사유지 등 기존 사각지대에서 발생하는 음주·약물운전도 강력한 행정처분 대상에 포함될 전망이다.
이 의원은 “이번 법안은 ‘도로가 아니었다’라는 핑계를 악용해 행정제재를 피하려는 꼼수를 막기 위한 것”이라며 “장소를 가리지 않고 국민 안전을 위협하는 음주·약물·난폭운전은 무관용 원칙으로 엄단해야 한다”고 말했다. 이어 “형사처벌과 행정처분의 불균형을 바로잡아, 국민의 생명과 안전을 한층 더 두텁게 보호하겠다”고 강조했다.
