Representative Yoon Jae-ok of the People Power Party (Daegu Dalseo-eul) has introduced two bills to normalize the National Election Commission (NEC), with the core provisions being the conversion of the NEC chairperson to a permanent position and the establishment of grounds for the attendance of regional NEC chairpersons at parliamentary audits.

The partial amendments to the National Election Commission Act and the National Assembly Act, proposed by Rep. Yoon on the 24th, include provisions to convert the chairpersons of not only the Central NEC but also city, provincial, and district/city/county NECs to permanent positions.

Critics point out that the fundamental cause of the NEC's repeated poor election management is the operation of its vast nationwide organization under a non-permanent commissioner system.

Under current law, there is only one permanent commissioner each at the central and city/provincial NECs; conversely, the chairpersons of the NECs at all levels—the highest-ranking officials—are all non-permanent honorary positions, which have conventionally been held concurrently by incumbent judges. Due to this structure, constant command and supervision of the organization's internal affairs has been difficult, leading to persistent controversies over lax discipline, including confusion in election site management, allegations of preferential hiring, and staff taking deceptive leave during election seasons.

Representative Yoon explained, "This very non-permanent structure played a significant role in the National Election Commission repeatedly suffering from poor management issues," adding, "The core of this amendment is to elevate the chairperson to a permanent position to grant them substantial authority and responsibility, and to establish a system of continuous management."

A new provision was added to the accompanying amendment to the National Assembly Act, designating "National Election Commissions at all levels" as agencies under the jurisdiction of the National Assembly's Public Administration and Security Committee. Consequently, grounds have been established for the attendance of regional commission chairpersons or their representatives at parliamentary audits, which is expected to further strengthen the National Assembly's oversight and checks functions. Representative Yoon emphasized, “The National Election Commission (NEC) has evaded internal control and external oversight under the pretext of being an independent body under the Constitution, resulting in structural and recurring failures.” He added, “This amendment will restore democratic and public control over the NEC and serve as a starting point for restoring public trust in elections.”

He also stated, “It is merely a custom for a judge to serve as the NEC chairperson, not a legal obligation.” He further noted, “Since holding concurrent positions will become virtually impossible once the position becomes permanent, we plan to devise new operational measures to align with the institutional changes.”

Meanwhile, while there is agreement within and outside political circles regarding the intent of the system—to enhance the NEC’s accountability and transparency—discussions are expected to continue in the National Assembly regarding the balance between guaranteeing the NEC’s independence and strengthening the National Assembly’s oversight function, as well as measures to expand personnel and budget following the permanent transition and secure political neutrality.
