현행 공직선거법상 자원봉사자에게는 법정 수당이나 실비 지급이 금지되어 있으며, 정식으로 선거사무관계자로 등록된 경우에만 일정 범위 내에서 지급이 허용된다.  

선관위는 A씨가 D씨, E씨에게 수당을 지급할 수 있는 것처럼 허위로 지급명세서를 작성한 정황도 함께 확인해 고발 대상에 포함했다.

이번 사건의 쟁점은 자원봉사자 허위 등록 여부, 수당 지급의 적법성, 지급명세서 허위 작성 경위, 관련자들의 공모 사실 등이다. 검찰은 계좌 거래 내역과 지급명세서, 관계자 진술 등을 토대로 정확한 사실관계 파악에 나설 예정이다.

공직선거법 제135조는 선거사무관계자에게 지급이 가능한 수당과 실비의 범위를 정하고 있다. 해당 규정을 위반해 금품을 제공하거나 수수한 경우, 같은 법 제230조에 따라 5년 이하의 징역 또는 3천만 원 이하의 벌금이 부과될 수 있다.
