"대장부 한번 가면 다시 돌아오지 않으리. 바람은 쓸쓸하고 역수는 차구나. 술을 대하고 노래하나니 인생이 무엇이던가. 아침이슬 같으리니. 가버린 세월이 너무 많도다."

이 노래는 중국의 삼국시대 때 위기에 처한 위나라 병졸들이 불렀겠다. 촉의 제갈량이 사마의가 빼앗긴 군량미를 되찾으려는 상방곡으로 몰아넣고는 화공으로 제압하자, 승리할 가망이 없다는 판단 하에 사마의는 병사들에게 투항을 명하고는 스스로 목숨을 끊으려했다. 사마소와 병사들은 투항하라는 명령을 거부하며 이 노래를 부르면서 결전의 의지를 불태웠겠다. 원래 이 노래는 연나라 자객 형가가 진시황을 암살 차 출전할 때, 역수에서 불렀다고 사마의는 중얼거린다. 그러나 제갈량의 운은 여기서 끝난다.

이때 마침 소낙비가 내려 되레 반전이 됐기 때문이다. 이제는 촉의 제갈량이 사지에 몰리게 되면서 곧 죽게 된다. 그의 나이 54세였다. 그때 위나라의 군량미를 빼앗아 상방곡으로 숨긴 위연도 죽게 된다. 끝내는 사마의의 승리였다. 이로써 조씨가의 위나라를 장악하고는 사마의 또한 72세의 일기로 하직한다. 그의 손자인 사마염이 지긋지긋한 삼국시대를 끝내고 진을 건국한다. 중국의 역사는 이렇게 진화했다. 

지금 우리의 역사도 역경 속에서 진화한다. "선은 악을 이긴다" 그리고 "정의는 끝에서야 빛날 때가 많다"는 점을 되새기고자 한다.

악의 질주는 이제 멈출 것 같다. 즉, 탄핵정국에서 야당이 권력을 탈취하려고 온갖 술수를 부리면서도 이를 정의로 가장하였다. 지금까지 그릇된 판세이나 제갈량과 같았지만, 이제 시간은 '사마의와 같은 시간'이다는 판단이다. 탄핵이란 마차가 곧 생명을 다한다.

탄핵심판, 원천적인 불법탄핵임에는 애초부터 내 법적판단은 지금까지 변함이 없다. 대한민국 법과대학에서 충실한 수학이었다면 개인적•집단적 미움은 있을지언정 비상계엄은 헌법상 불법은 아니었고, 형사상 내란죄는 성립 자체가 될 수 없었다는 점이다.

더구나 절차상의 난맥은 되레 국가를 전복하려는 야당인 쿠테타세력만의 '한시법' 내지 '임시적 조치'나 다름없다. 그럼에도 탄핵이 된다는 예단으로 한자리를 탐하는 학자나 불법세력까지 준동하여 아전인수격 법해석이었으니 애초롭기 그지없다.

따라서 윤석열 대통령 탄핵문제는 '기각' 아니면 '각하'로 마무리될 것이다. 설사 비상계엄이 부적법했다고 보더라도, 대통령을 파면시킬 정도의 중대성이 있느냐의 문제로도 귀결된다. 더구나 대한민국 법과 법관의 양심은 쉽게 허물어지 않을 것이기 때문이다.

만약 이게 허물어진다면 대한민국의 법치주의는 사망을 고할 것이다. 또한 세계만방에 웃음거리가 되면서 민주주의의 후퇴를 가져올 것이라는 점을 깨달아야 할 때다.

Furthermore, the procedural chaos is no different from a 'temporary law' or 'temporary measure' only for the opposition party, the coup forces, who are trying to overthrow the country.
