【브레이크뉴스 포항】박영재 기자=포항시의회 의원연구단체 ‘블루오션’(대표의원 김만호)은 지난 20일 오후 시의회에서 최병근 박사(법무법인 ‘뿌리’ 대표변호사)를 초청해 ‘민간공원 특례사업 초과이익 환수 정책 세미나’를 개최했다.

이번 세미나는 민간공원 특례사업 추진 과정에서 발생하는 초과이익 환수 제도의 타당성과 법적 근거를 점검하고, 광주광역시 등 타 지자체의 사례를 참고해 포항시에 적합한 제도적 대안을 모색하기 위해 마련됐다.

발제에 나선 최병근 박사는 “2009년 민간공원 특례사업 제도 도입 당시에는 관련 법령에 초과이익 환수 조항이 없었다”며 “2022년 개발행위특례지침 개정으로 수익률 및 초과이익에 대한 공공기여 규정이 신설됐지만, 이를 명확히 하고 강제력을 확보하기 위해서는 대통령령이나 하위 법령 수준의 구체적 규정이 필요하다”고 강조했다.

또한 그는 광주광역시의 사례를 들어 “해당 지자체는 실시협약을 공개하고 초과이익 환수 내용을 명확히 명시함으로써 시민의 알 권리를 적극 보장하고 있다”고 소개했다.

세미나에 참석한 블루오션 소속 의원들은 “포항시의 민간공원 특례사업은 현재 협약 사항이 비공개로 유지돼 시민의 알 권리가 침해되고 있다”며 “초과이익 환수의 타당성 검증 절차를 별도로 마련할 필요가 있다”고 입을 모았다. 이들은 실시협약 등 관련 문서의 투명한 정보 공개와 철저한 검증 절차의 병행을 촉구했다.

블루오션은 이번 세미나 논의 결과를 바탕으로 포항시를 상대로 정보공개 청구와 추가 검증 절차를 추진할 계획이며, 민간공원 특례사업이 시민들에게 실질적인 혜택으로 이어질 수 있도록 지속적으로 감시하고 대응해 나가겠다고 밝혔다.

한편, 포항시의회 의원연구단체 ‘블루오션’은 2023년에 결성된 단체로, 대표의원 김만호를 비롯해 박희정·김상민·박칠용·최광열·김은주 의원 등이 참여하고 있다. 환경문제와 지역 주요 현안을 주제로 세미나 및 연구 활동을 이어가고 있다.

Blue Ocean lawmakers attending the seminar unanimously stated, "The details of Pohang City's private park special project are currently kept confidential, violating citizens' right to know. We need a separate verification process for the validity of excess profit recovery." They urged the transparent disclosure of information in implementation agreements and other related documents, along with a thorough verification process.

Based on the results of this seminar, Blue Ocean plans to file a Freedom of Information request and pursue additional verification procedures with Pohang City. It also announced that it will continue to monitor and respond to ensure that the private park special project delivers tangible benefits to citizens.

Meanwhile, the Pohang City Council's research group, "Blue Ocean," was founded in 2023 and includes Representative Councilor Kim Man-ho, as well as Councilors Park Hee-jung, Kim Sang-min, Park Chil-yong, Choi Gwang-yeol, and Kim Eun-ju. The group continues to hold seminars and conduct research on environmental issues and key local issues.
