본지 취재 결과 경북 포항시 북구 송라면장은 18일 오전 국민의힘 소속 광역의원 출마 예정자의 배우자와 함께 면사무소를 돌며 직원들에게 인사를 시킨 것으로 확인됐다. 이 과정에서 일부 공무원들 사이에서는 “선거를 앞둔 시점에서 부적절한 처신 아니냐”는 반응도 나온 것으로 전해졌다.

논란의 핵심은 면장이 자신의 직위를 이용해 특정 출마 예정자 측 인물을 공직사회 내부에 사실상 소개한 행위가 공무원의 정치적 중립 의무를 위반한 것 아니냐는 점이다.

현행 공직선거법은 공무원의 선거 관여 행위를 엄격히 제한하고 있다. 지방공무원법 역시 공무원의 정치적 중립 의무를 명시하고 있다. 특히 공무원이 직무상 권한이나 조직 내 영향력을 활용해 특정 후보자 또는 출마 예정자에게 유리한 분위기를 조성하는 행위는 선거법 위반 논란으로 이어질 수 있다.

또 다른 지역 정치권 관계자는 “면장은 지역 행정조직을 총괄하는 위치에 있는 만큼 산하 공무원들에게 미치는 영향력이 적지 않다”며 “출마 예정자 측 인물을 동행시켜 인사를 시킨 행위 자체만으로도 공직사회에 정치적 신호로 받아들여질 가능성이 크다”고 지적했다.

반면, 해당 공무원에 대한 동정론도 나오고 있다. 오는 6.3선거에서 경북도의원으로 출마했지만 얼마전 까지만 해도 포항시의원이었던 후보자의 배우자가 선거 옷차림으로 관공서를 찾아간 사실 역시 부적절 했다는 비판이다.

공무원의 입장에서는 이러지도 저러지도 못하는 상황ㅇ일수 밖에 없다는 것이다. 실제 위법 여부는 당시 발언 내용과 인사 방식, 반복성, 선거 연관성 등을 종합적으로 따져 판단될 것으로 보여 선관위의 대응이 주목된다.   

이에대해 해당 면장은 정치적 의도는 없었다고 해명했다. 이어 “방문한 사람이 도의원 출마 예정자의 배우자라고 소개하며 들어왔고, 직원들 얼굴을 잘 모른다고 해 단순히 인사만 하고 가시라고 한 것”이라며 “특별한 관계는 없고 개인적으로 잘 알지도 못한다”고 밝혔다. 이어 “경솔했다”며 “앞으로 더욱 주의하겠다”고 말했다.

However, as the actual legality is expected to be determined by comprehensively examining the content of the remarks made at the time, the manner of the greetings, the frequency of the incident, and its connection to the election, the response of the National Election Commission is drawing attention.
