본지가 입수한 음성녹음 파일에는 김 의원이 최근 포항 북구 청하면 특정 관변단체장에게 전화를 걸어 국민의힘 소속으로 경북도의원에 출마한 김상백 후보를 도와달라는 취지의 발언을 했다.

녹취록에 따르면 김 의원은 “이번 지방선거에서 국민의힘이 김상백 의원을 공천했다”며 “지난 4년간 시의원으로 일을 시켜보니 성실하게 일을 잘해 이번에 도의원으로 출마했다. 일할 수 있도록 꼭 힘 좀 써달라. 도와달라”고 말했다. 하지만 김상백 포항시의원은 지난 2023년 4·5 재보궐선거를 통해 당선된 것으로 확인돼, 발언 내용과 실제 의정활동 기간 사이에 차이가 있는 것으로 나타났다.

이를 두고 지역에서는 선거운동을 할 수 없는 위치에 있는 인사들에게 사실상 특정 후보 당선을 위한 활동을 요청한 것 아니냐는 지적이 나오면서 공직선거법 위반 논란으로 번지고 있다.

특히 국민의힘 공천 과정에서 탈락하거나 갈등 끝에 탈당한 인사들이 잇따라 무소속 출마에 나선 상황과 맞물리면서, 현역 국회의원이 직접 지역 조직망을 상대로 이른바 ‘표 단속’에 나선 것 아니냐는 비판도 제기된다.

논란이 커지는 배경에는 접촉 대상이 지역 관변단체장이라는 점도 자리하고 있다. 이들은 주민들과 밀접하게 접촉하는 위치에 있는 만큼 정치적 중립성이 요구되는 자리라는 지적이다.

지역 정치권 관계자는 “특정 후보를 콕 집어 지지를 호소한 것은 결국 상대 후보에게는 낙선을 의미하는 것으로 받아들여질 수밖에 없다”며 “현역 국회의원의 정치적 영향력을 감안하면 단순한 개인 의견 표명을 넘어선 문제”라고 말했다.

이어 “이들 조직은 지역 민심과 연결돼 있는 사실상 풀뿌리 조직”이라며 “국회의원이 직접 전화해 특정 후보를 거론한 것 자체가 지역사회에서는 강한 정치적 메시지로 받아들여질 수밖에 없을 것”이라고 말했다.

현행 공직선거법상 국회의원은 자당 후보를 위한 선거운동 자체는 가능하다. 후보 선거사무소 개소식 참석이나 공개 지지 발언, 유세 지원, SNS를 통한 지지 호소 등은 원칙적으로 허용된다. 다만 선거운동은 법이 정한 범위와 방식 안에서 이뤄져야 한다.

한 법조인은 “실제 위법 여부는 발언 내용과 표현 수위, 통화 대상 범위, 반복성, 조직성, 선거에 미칠 영향 등을 종합적으로 따져 판단하게 될 것”이라며 “현역 국회의원이 지역 주민들과 밀접하게 연결된 단체장들을 상대로 특정 후보 지지를 직접 언급한 것 자체만으로도 매우 부적절하다는 비판이 나올 수 있다”고 말했다.

한 시민단체 관계자는 “국회의원이 자신의 정치적 영향력을 활용해 지역 조직에 사실상 정치적 선택을 요구하는 것은 민주주의 원칙에도 맞지 않는다”며 “단순한 의견 표명을 넘어선 선거 개입 여부에 대해 철저한 검증이 필요하다”고 주장했다.

이에 대해 포항시 북구선거관리위원회 관계자는 “관변단체장은 선거운동을 할 수 없는 사람에 해당된다”며 “만약 김정재 의원이 실제로 전화를 걸어 주민들에게 특정 후보 지지를 유도하거나 종용했다면 공직선거법 위반 소지가 있을 수 있다”고 말했다.

In response, an official from the Pohang City Northern District Election Commission stated, “Heads of government-affiliated organizations are prohibited from engaging in election campaigning,” and added, “If Assembly Member Kim Jeong-jae actually made phone calls to induce or urge residents to support a specific candidate, there is a possibility of a violation of the Public Official Election Act.”
