강 후보는 대한체육회 선거운영위원회가 적법하지 않은 절차를 거쳐 선거인단 명부를 작성했기 때문에 선거인단 명부를 신뢰할 수 없고, 불공정한 선거를 치르게 됐다는 판단이 들어 서울동부지방법원에 선거중지가처분을 신청하게 됐다고 밝혔다.

강 후보는 지난해 12월 26일 후보등록 마감 후 대한체육회 선거운영위원회로부터 선거인단 명부를 전달받아 선거 운동을 하는 과정에서 선거인단 구성이 잘못됐다는 것을 확인했다.

먼저 고인이 되신 분이 선거인단에 포함된 사실을 확인했다. 강 후보 캠프에서 선거운동을 위해 선거인에게 연락을 취하자, 배우자가 전화를 받아 사망한 사실을 확인해주었다.

또한, 입대한 선수들도 선거인단에 포함됐습니다. 현재 테니스 선수 1명, 레슬링 선수 1명이 각각 육군훈련소에 배치되어 훈련 중인 사실을 확인했다.

이번 가처분 신청을 결정한 배경은 대한체육회 선거운영위원회가 적법한 절차대로 선거인단을 구성하지 않았음에도 불구하고 잘못을 인정하고 시정하려는 태도를 보이지 않아 바로잡겠다는 취지로 결정한 것이다.

강 후보 측은 지난 40대와 41대 선거에서 유사한 문제가 발견됐을 때 선거운영위원회에 시정조치를 요구했으나 “모두가 동일한 조건에서 선거를 치른 것 아니냐”는 황당한 답변을 받은 사실이 있다. 이러한 관행을 바로잡기 위해서는 반드시 법적인 판단을 받을 필요가 있다는 것이 강 후보 캠프의 의지이다.

한편 이번 가처분 신청(서울동부지방법원 2005카합10003)은 사안의 시급성이 인정되어 1월 10일 오후 3시 심문기일이 열린다.
