단체는 특히 포항시가 과거 도시관리계획 결정을 불허했던 입장에서 행정소송 패소 이후 빠르게 인허가를 승인한 점을 문제로 지적했다. 행정 태도 변화의 배경에 지역 정치권과 언론, 전직 공무원 등이 얽힌 유착 의혹이 있다는 주장이다. 주민 의견 수렴 절차가 제대로 이뤄지지 않았다는 점도 지적했다.

논란은 인허가 과정에 관여했던 전직 공무원들이 사업 관련 회사로 자리를 옮긴 사실이 알려지면서 더욱 확산되고 있다. 포항시 북구청 허가과장을 지낸 A씨는 퇴직을 앞두고 명예퇴직한 뒤 해당 사업 관련 회사 이사로 취업한 것으로 확인됐다. 전 포항시 남구보건소장 출신 B씨도 관련 회사와의 연관성이 거론된다.

지역사회에서는 인허가에 관여했던 공무원의 관련 업체 취업이 이해충돌 소지가 있다는 지적이 나온다. 사업 관련 회사 대표와 임원 일부가 지역 정치권과 연관된 이력을 갖고 있고, 계열사로 추정되는 업체 대표가 지방선거 출마 예정자로 거론되는 점도 의혹을 키우고 있다. 관련 업체 임원진에 지역 언론사 관계자가 포함된 의혹도 일고있다.

해당 시설은 하루 48톤 규모의 의료폐기물 처리시설로, 2019년 사업계획서 제출 이후 환경부 통합허가를 받으며 추진됐다. 이후 포항시가 도시관리계획 결정을 불허하면서 사업이 중단됐으나, 사업자가 제기한 행정소송에서 포항시가 패소하면서 상황이 바뀌었다. 2025년 4월 도시관리계획이 고시되고 같은 해 9월 건축허가가 완료되면서 공사가 진행 중이다.

건축허가 과정에서는 14개 부서 협의가 진행됐으며 다수 부서가 허가 가능 의견을 냈다. 다만 일부 부서는 주민 의견 반영과 재해영향평가, 수질관리 계획 보완 등을 요구한 것으로 나타나 형식적 협의에 그쳤다는 비판도 제기된다. 포항시는 “모든 행정 절차는 법과 기준에 따라 진행됐다”는 입장을 밝혔다.

포항환경운동연합은 최근 인허가 관련 자료와 전직 공무원 직무 수행 내역 등에 대한 정보공개를 청구했으며, 국민권익위원회 조사 요청과 감사원 감사 청구도 추진할 계획이다.

Pohang City stated that "all administrative procedures were conducted in accordance with laws and standards."

The Pohang Federation for Environmental Movement recently filed a request for the disclosure of information regarding permit-related data and the performance records of former public officials. The group also plans to pursue a request for an investigation by the Anti-Corruption and Civil Rights Commission and an audit by the Board of Audit and Inspection.
