선관위에 따르면 지난해 말 개최된 A씨의 출판기념회에서 B씨는 자신의 지인 5명을 동원해 선거구민이 포함된 약 1천여 명의 참석자에게 공연을 제공한 혐의를 받고 있다. 선관위 관계자는 “B씨와 지인 5명은 출연료를 받고 활동하는 전문 공연인으로, 출판기념회 참석자들에게 관람료 상당의 재산상 이익을 무상으로 제공한 것으로 판단했다”고 설명했다.

공직선거법 제113조(후보자 등의 기부행위 제한)에 따르면 후보자 또는 후보자가 되고자 하는 자는 해당 선거구 안에 있는 사람이나 기관·단체·시설, 또는 선거구 밖에 있더라도 선거구민과 연고가 있는 자에게 기부행위를 할 수 없다. 또한 같은 법 제114조(정당 및 후보자의 가족 등의 기부행위 제한)는 후보자의 직계존·비속과 형제자매 등이 후보자를 위해 일체의 기부행위를 하는 것을 금지하고 있다.

이를 위반할 경우 공직선거법 제257조 제1항에 따라 5년 이하의 징역 또는 1천만 원 이하의 벌금에 처해질 수 있다.

선관위는 “선거의 공정성을 훼손하는 행위에 대해서는 엄정하게 조치할 방침”이라며 “유사 사례가 발생하지 않도록 각별한 주의가 필요하다”고 밝혔다.
