SBS 단독 보도에 따르면 조 의원의 배우자 정 모씨는 지난 2000년 경북 포항시 오천읍 일원의 땅 약 1만 3천 제곱미터의 과수원 부지를 상속받아 자신이 직접 경작한다고 신고한 것으로 알려졌다.

하지만 이 땅을 경작하는 사람은 따로 있었다. SBS는 조명희 의원 가족이 1년에 400만 원을 주고받는 조건으로 임대차 계약이 있었다면서 이 자체로 농지법 위반이라고 보도했다. 

SBS는 또, 농지법상 농업 경영을 하지 않으면 1만 제곱미터 넘는 농지는 상속받아 소유할 수 없다는 현행법도 강조했다. 여기에 전체 1만 3천여 제곱미터의 땅 가운데 일부(4천여 제곱미터 목장용지, 800여 제곱미터 잡종지)는 용도와 다르게 경작되고 있는 점도 확인했다. 특히, 실제 농민에게는 정부가 제공하는 농지 직불금이나 퇴비 등의 지원도 되지 않았다. 조 의원 가족이 경작을 하는 것처럼 신고되어 있었기 때문이다.  

현행법상 임대차 계약을 한 경우에는 수정을, 그 뒤에도 수정을 하지 않을 경우에는 행정기관이 직권으로 처분도 가능하며, 농지 임대차 규정 위반이 확인되면 2천만 원 이하 벌금에 처해질 수도 있다. 

한편, 조명희 의원의 남편 정모씨는 SBS에 “직접 경작하지 않고도 자경한다고 신고한 건 잘못했다”고 인정했다. 또 "농업 경영을 하지 않은 채 상속 받은 농지를 1만 제곱미터 넘겨 소유한 것은 위법한지 몰랐다"고 해명한 것으로 알려졌다. 

조명희 의원의 논란은 여기서 끝이 아니다. 지난 22일 있었던 국회 국토교통위원회 결산 심사는 조 의원의 예산 끌어쓰기 의혹으로 회의 시작 25여 분 만에 정회하는 소동이 발생했다. 이에 앞서 조 의원은 자신이 대주주로 속해 있는 업체와 상임위가 업무적으로 관련성이 있다 해서 야당 측이 이해충돌 의혹을 제기한 바 있다. 

당시 야당은 ‘조 의원이 대주주로 있는 업체의 특정 사업에 수억 원의 증액이 요구됐고, 실제로 반영됐다’고 주장했다. 이 업체의 예산 증액에는 조 의원 뿐만 아니라, 국민의힘 다른 의원들도 동참했던 것으로 알려졌다. 해당 의원 중 일부가 조 의원에게 수백만 원의 후원금을 받았다는 의혹도 제기됐다. 이와 함께 야당은 1)상임위 차원에서 조 의원 사·보임 2)사·보임 전까지 상임위 회의에서 특정 업체 이익을 위한 법안 심사 시 직권 제지 등을 요청했다.

논란이 되자 조 의원은 "국토위에 들어온 후 백지신탁을 끝냈고 대표이사직도 사임했다. 가족도 이해충돌과 관련한 소지를 없앴다"며 "사업은 어느 부처에서 발주했을 것이다. 그 건은 잘 모른다. 그 회사에서 1원도 발주받은 적 없다"고 항변했다(뉴시스 기사 발췌)

그럼에도 대구 지역 정치권에서조차 “제자들을 위해 만들고 대주주로 있다고 하는 업체의 예산 증액을 요구하고 해당 직무와 관련성이 짙은 상임위에서 활동하는 것은 매끄럽지 못한 정치행보”라며 “비례대표 국회의원으로서 지역구 출마까지 고려할 수도 있을 텐데 이런 오점과 흔적을 남기는 것은 지역주민들에게도 상당한 흠집으로 작용할 수 있다. 이는 국회의원과 국민간의 신뢰의 문제이기도 하다”고 지적했다. 

조 의원은 지난 2020년 총선에서 비례대표로 국회에 진출했다. 위성을 활용한 지리정보시스템 업체를 창업했으며 그 회사의 비상장주식 46억 원어치를 소유하고 있는 것으로 알려졌다.
