지난 1년간 본 법률에 따라 고행기부금 제도가 운영됐지만, 제도 운영과정에서 여러 종류의 어려움이 도출됐다. 이번 개정으로 그동안 드러난 지방자치단체의 애로사항 해소와 함께 기부자가 기부금이 사용될 목적과 사업을 지정하여 기부하는 ‘지정기부’의 법률상 근거가 명확해졌다.

개정안 주요 내용으로는 현행법에서는 금지하고 있던 모금 방법, 즉 전자적 전송매체(문자메시지 등)와 사적모임(동창회, 향우회 등)을 통한 기부의 권유·독려행위가 허용된다. 다만 과도한 기부 권유·독려행위를 방지하기 위해 모금의 횟수와 형식 등 모금 방법과 절차를 대통령령으로 규정하고, 모금 활동은 지방자치단체의 명의로만 해야한다는 규정은 별도로 두었다.

두 번째로는 현재 연간 500만 원으로 설정 되어 있는 개인의 고향 사랑 기부 상한액을 2025년부터는 2천만 원으로 확대된다. 세액공제 혜택도 동반 확대된다. 기부자가 기부금이 사용될 사업을 선택해 기부하는 ‘지정기부’의 법률상 근거도 명확히 했다. 기부자가 실제 본인이 기부하는 기부금이 어떠한 사업 또는 누구를 위하여 쓰여질 계획인지를 알 수 있게 되어 기부의 투명성과 효능감이 높아질 것으로 기대된다.

이번 개정 법률안은 2월 국무회의에서 공포되어 즉시 시행될 예정이다. 다만, ‘모금방법 확대(제7조 제1항)’,와 ‘고향사랑 기금에서 답례품 비용 충당(제11조 제2항 본문 및 같은조 제4항)’은 공포 후 6개월 뒤 시행된다.

 또, 고향사랑기부 연간 상한액 상향(제8조 제3항)은 세액공제 혜택 제공을 위한 ‘조세특례제한법’ 개정이 필요한 사항이라 2025년 1월에나 비로소 시행될 예정이다. 

이상민 장관은 “이번 법률 개정은 고향사랑 기부제 시행 2년 차를 맞아 지자체의 자율성과 제도의 명확성을 동시에 강화하고자 한 것”이라며 “앞으로도 고향사랑 기부제가 지방재정을 확충하고, 지역경제 활성화와 국가 균형발전에 기여할 수 있도록 적극적으로 제도개선을 해 나가겠다”고 밝혔다.
