경기도 성남시 대장동 개발과 관련하여 의혹이 불거진 곽상도 전 국회의원의 구속 영장이 1일 법원에서 기각됐다.
곽상도 전 의원은 대장동 개발사업 과정에서 화천대유자산관리가 하나은행과 컨소시엄을 구성하는데 도움을 주고 이를 통해 아들의 퇴직금 등의 명목으로 50억원을 챙겼다는 혐의를 받고 있다.
이 가운데 지난 29일 서울중앙지검 전담수사팀(팀장 김태훈 4차장검사)은 곽상도 전 의원에게 특정경제범죄 가중처벌법상 알선수재 혐의를 적용해 사전구속영장을 청구했다.
그러나 이에 대해 1일 서울중앙지법 서보민 영장전담 부장판사는 “범죄 성립 여부에 대한 다툼의 여지가 있어 피의자의 방어권 보장이 필요한 것으로 보이는 반면 구속의 사유 및 필요성·상당성에 대한 소명이 부족하다”고 이유를 밝히며 구속영장을 기각했다.
이는 사실상 검찰이 혐의 소명을 제대로 못했다는 뜻으로 이로 인해 관련자 진술과 일부 자료에만 의존해 단 한 차례의 조사 만으로 영장을 청구한 게 다소 성급했다는 지적이 이어지고 있는 가운데 50억 클럽의 수사 첫 걸음부터 가로막힌 검찰은 수사 동력에 큰 타격을 입은 것으로 추측된다.
한편 이날 곽상도 전 의원은 “50억 클럽이라는 게 실체가 있는지 의문”이라면서 아들 병채씨가 직급에 비해 과도한 퇴직금을 받았다는 지적에 대해 “회사(화천대유)가 남들이 상상할 수 없는 돈을 벌었기 때문에 이런 이상한 일들이 생겼다고 생각한다”는 입장을 밝혔다.
