지난 8일 서울중앙지법 형사22부는 곽상도 전 의원이 아들의 퇴직금과 성과급 명목으로 50억 원을 뇌물을 수수한 혐의에 대해 무죄를 선고했다.

이에 대해 민주당 대구시당‧경북도당 대학생·청년위원회는 “곽상도 아들이 받은 퇴직금이 뇌물이 아니라면 5년 10개월 된 대리가 받은 퇴직금 50억이 정상인가?”라고 따져물었다.

그러면서 “재판부는 사회통념상 이례적으로 과다하다고 말하면서도 아버지(곽상도 전 의원)로부터 생계를 독립했기 때문에 대가성으로 보기 어렵다고 말했는데 이는 편법 증여에 새로운 예를 만들어주는 어처구니 없는 판결”이라고 꼬집었다.

이들은 “유권무죄, 무권유죄의 검사 독재정권”이라면서 “재판부의 1심 무죄 선고는 납득하기 어렵다.”고 목소리를 높이며 “2심에서는 누가 보더라도 납득할 수준의 공정한 판결이 이루어져야 할 것”이라고 강조했다.

아울러 “검찰은 형량을 입증할 만한 증거를 분명하게 준비하고 제시하길 바란다.”면서 “더불어민주당 대구시당•경북도당 대학생•위원회청년위원회는 이러한 상황을 인지하고, 견제 세력의 역할을 성실히 수행할 것”이라고 덧붙여 말했다.
