HIV장애인정을위한전국연대는 17일 오후 1시, 국가인권위원회 대구인권사무소 앞에서 HIV 감염인이라는 이유만으로 수술거부를 당하는 감염인들의 권리 확보와 인권 보호를 위해 기자회견을 개최했다.

지난 1월 대구 달서구의 한 접합전문병원을 찾은 HIV 감염인 A씨는 발뒤꿈치 골절로 수술이 필요하다는 소견을 받았다. 그러나 담당 의사의 안내에 따라 수술 일정을 잡고 준비를 마친 상태에서 병원은 당일 돌연 수술을 거부했다.

병원은 ‘면역계통의 내과적 사정’을 수술 거부 사유로 들었다. 결국 A씨는 대체 치료조차 받지 못한 채 인근 동네 병원으로 가 깁스 치료를 받았다.

장애인차별금지법 제32조는 장애를 이유로 의료기관이 진료나 치료를 거부해서는 안 된다고 명시하고 있다. HIV 감염인은 해당 법상 장애인으로 인정되기 때문에, 이와 같은 진료 거부는 명백한 차별에 해당한다.

HIV 장애 인정을 위한 소송 대리인단 윤이나 변호사는 “HIV 감염인에 대한 차별을 감추기 위한 변명에 불과하다”며 “HIV 감염인에 대한 사회적 낙인과 편견이 의료 현장에서 얼마나 뿌리 깊이 자리 잡고 있는지를 여실히 보여주는 사건”이라고 강하게 비판했다.

레드리본인권연대 제드씨는 “HIV 감염인들은 질병을 넘어 사회적으로도 신체적으로도 장애를 겪고 있는 존재”라며 “이들을 장애인으로 분명히 인정하고 제도적으로 보호 장치를 마련하는 것은 더 이상 미룰 수 없는 과제”라고 강조했다.

현재 일본, 홍콩, 영국은 HIV 감염인을 법적으로 장애인으로 간주하고 있으며, 미국, 호주, 독일 등도 장애인 차별 금지법을 통해 HIV 감염인을 보호하고 있다.

HIV장애인정을위한전국연대는 기자회견 직후 국가인권회를 찾아 진정서를 접수했다. HIV 감염을 이유로 한 수술 거부 행위가 장애인 차별금지법상 장애인 차별 금지법 위반임을 확인하고 재발 방지를 위한 적극적인 시정 권고 요구, 병원이 HIV 감염인에 대한 차별과 인권 침해를 근절하기 위한 인권 교육을 전 직원이 이수하도록 권고하고 이를 관리 감독할 지방자치단체의 책임을 분명히 할 것, HIV 감염인들이 의료 현장에서 더 이상 차별받지 않고 동등하게 치료받을 권리를 확립할 것 등에 대한 내용이다.
