7일 대한에이즈예방협회 대구경북지회와 레드리본인권연대 등 시민단체들은 성명을 내고 “국가인권위가 발표한 ‘HIV 감염을 이유로 한 수술 거부’의 권고 결정을 환영한다”고 밝혔다.

이 사건 진정인 A씨는 지난 2020년 9월 근무 중 오른쪽 엄지손가락이 기계에 말려 들어가 절단되는 사고를 당했다. A씨는 B병원으로 이송됐으나 HIV 감염인이라는 이유로 수술을 거부당해 평생 손가락을 굽힐 수 없게 됐다고 주장하고 있다.

인권위는 HIV 감염인의 수술을 거부한 B병원에 대해 “특정인을 합리적인 이유 없이 불리하게 대우하는 평등권 침해 차별행위를 했다”며 재발 방지를 권고했다.

또 A씨의 경우 '장애인복지법'상 등록 장애인에 해당하는 손상은 없지만, 10년 이상의 HIV 항바이러스제 복용으로 인한 후유증을 동반하고 있고, 해당 사건의 차별행위로 인해 손가락 기능이 상실된 점을 미뤄 장애인차별금지법 상 장애인에 해당한다고 판단했다.

단체는 "그간 에이즈 감염을 이유로 한 수술·치료·입원 거부는 의료현장에서 비일비재하게 발생했다”며 “인권위는 다른 국가기관에 제도적·실무적 개선사항을 제안해 HIV 감염인들이 지역사회에서 의료·재활·취업·문화 활동을 하는데 필요한 정당한 편의를 제공받을 수 있도록 개선에 앞장서줄 것을 기대한다”고 밝혔다.

한편 2016년 국가인권위원회에서 실시한 HIV/AIDS 감염인 의료차별 실태조사에 따르면 의료기관의 차별 진정사건의 수가 전체 HIV감염인 진정사건 중에 절대적 다수를 차지하고 있다. 

또 HIV 감염인 의료차별의 다양한 영향력 요인을 분석한 결과 HIV/AIDS감염인에 대한 낙인과 차별이 가장 심각한 것으로 조사된 바 있다.

Meanwhile, according to a survey on medical discrimination against HIV/AIDS patients conducted by the National Human Rights Commission of Korea in 2016, the number of complaints against discrimination by medical institutions accounts for the absolute majority of complaints related to HIV infection.

In addition, as a result of analyzing various influence factors of medical discrimination against people living with HIV, stigma and discrimination against people living with HIV/AIDS were found to be the most serious.
