【브레이크뉴스 경북 】이성현 기자=경북 안동의 한 고등학교에 상습적으로 침입해 시험지를 빼돌린 학부모와 기간제 교사가 실형을 선고받았다.

대구지법 안동지원 형사1단독은 14일 특수절도 등의 혐의로 기소된 학부모 A(40대)씨에게 징역 4년 6개월을, 기간제 교사 B(30대)씨에게 징역 5년과 추징금 3,150만 원을 선고했다.

이들의 범행을 도운 혐의로 기소된 학교 행정실장 C(30대)씨에게는 야간주거침입 방조 등의 혐의로 징역 1년 6개월이 선고됐다. 훔친 시험지라는 사실을 알고도 이를 이용해 시험을 치른 A씨의 딸 D(10대)양에게는 위계에 의한 업무방해 혐의로 징역 1년에 집행유예 2년이 선고됐다.

검찰에 따르면 학부모 A씨는 딸의 옛 담임교사였던 B씨와 공모해 2023년부터 지난해 7월까지 11차례에 걸쳐 딸이 재학 중이던 안동의 한 고등학교에 무단 침입했다. 이 과정에서 총 7차례에 걸쳐 중간·기말고사 시험지를 빼돌린 혐의로 재판에 넘겨졌다.

B씨는 시험지 유출 대가로 A씨로부터 16차례에 걸쳐 총 3,150만 원을 받은 것으로 조사됐다. A씨의 딸 D양은 유출된 시험지를 미리 외워 시험을 치른 결과, 고교 재학 기간 내내 내신 성적에서 전교 1등을 놓치지 않은 것으로 파악됐다.

이들의 범행은 지난해 7월 4일 기말고사 기간 중 학교 내 사설 경비 시스템이 작동하면서 드러났다. 

손 모 부장판사는 판결에서 “이번 사건은 교육에 대한 사회적 신뢰를 근본적으로 훼손한 중대한 범죄”라며 “해당 학교 학생들의 학습권과 공정하게 평가받을 권리를 침해했을 뿐 아니라, 성실히 노력해 온 수험생과 학부모에게 깊은 허탈감과 분노를 안겼다”고 지적했다.

이어 “사명감을 갖고 근무해 온 다수 교직원의 직업적 자존심까지 훼손했다”며 “피해 학교 교직원들의 엄벌 탄원이 있었고, 학부모 A씨가 증거인 휴대전화를 훼손한 점도 불리한 양형 요소로 고려했다”고 밝혔다. 다만 “교사 등 피고인들이 범행을 자백했고, 학부모 A씨가 학교 측에 1억 원을 공탁한 점은 참작했다”고 양형 이유를 설명했다.

 A parent and a temporary teacher who habitually broke into a high school in Andong, North Gyeongsang Province, and stole exam papers were sentenced to prison.

According to the prosecution, parent A conspired with his daughter's former homeroom teacher, B, to break into a high school in Andong, where his daughter was attending, on 11 occasions between 2023 and July of last year. He was indicted on charges of stealing midterm and final exam papers on seven occasions during this process.

Mr. B was found to have received a total of 31.5 million won from Mr. A over 16 occasions in exchange for leaking the exam papers. It was discovered that Mr. A's daughter, D, consistently ranked first in her school grades throughout her high school career, having memorized the leaked exam papers in advance.

Their crimes were revealed when the school's private security system was activated during the final exam period on July 4th of last year.

In his ruling, Chief Judge Son stated, "This incident is a serious crime that fundamentally undermines social trust in education." He added, "Not only did it violate the students' right to learn and their right to a fair evaluation, it also caused deep despair and anger to the students and their parents who have worked diligently."

He continued, "It also damaged the professional pride of many faculty and staff who have worked with a sense of duty." He added, "The fact that the faculty and staff at the affected school petitioned for severe punishment and that parent A damaged the evidence, a cell phone, were also considered unfavorable factors in sentencing." However, he added, "The fact that the teachers and other defendants confessed to the crime and that parent A deposited 100 million won with the school were taken into consideration."
