이번 세미나는 청년 일자리 문제를 해결하기 위한 50여 개 신직업 중 하나로 공인탐정업을 선정하여 법적·제도적 토대를 마련하겠다는 문재인 정부의 ‘미래 산업·직업구조 대비 신직업 활성화 방안’ 발표(2020.8.13. ｢비상경제 중앙대책본부 회의｣)에 발맞추어 탐정업 도입을 위한 입법화와 탐정업 관리감독의 실효성 제고 방안에 대해 논의하고자 개최된다.

그동안 탐정업에 대한 국민적 공감대와 수요가 높았음에도 법과 제도의 미비로 탐정이 합법적인 직업으로 정착되지 못하고 있는 실정이다.

실제, 경찰청이 2017년 4월 실시한 공인탐정제 도입에 대한 여론조사 결과 전체 응답자 중 72.3%가 탐정 법제화에 찬성한 바 있다.

하지만, 탐정업의 지도․감독기관을 어디로 할 것인가 하는 관할권 문제 때문에 지난 15여 년간 탐정업 도입 시도는 번번이 국회 입법 과정에서 무산되고 말았다.  

이러는 사이에 ‘심부름센터’, ‘사실확인대행’ 같은 음성적 민간조사업이 성행하게 되었고, 부도덕한 의뢰나 과도한 성과에 집착한 나머지 불법적이고 부당한 조사가 끊이지 않고 있다.

탐정업 제도는 OECD 가입국 중 우리나라에만 없는 제도로 대다수의 선진국에서는 탐정 활동이 합법적으로 이루어지고 있다. 미국의 경우 15개 주(州)에서는 경찰, 1개 주에서는 법무부, 21개 주에서는 별도 전담부서에서 공인 탐정을 관리 중이다.

영국과 프랑스는 내무부, 스페인은 경찰, 일본은 공안위원회 등에서 공인 탐정을 관리·감독하고 있다. 우리나라도 조사서비스의 수요가 폭발적으로 증가하고 있지만 경찰력만으로는 그 수요를 감당할 수 없는 실정이다.

다행스럽게도, 문재인 대통령은 대선 당시 ‘사실 조사를 지원하는 공인탐정제도 도입 추진’을 공약한 바 있다. 현재 정부에서도 국정과제로 추진 중(2017년5월)이며, 이에 발맞추어 도입계획까지 밝히고 있다.

현재, 국무조정실을 주축으로 법무부와 경찰청 실무자들의 논의가 진행되고 있고, 관리·감독기구 관할 부처 등을 지정해 내년 상반기까지 공인탐정법 제정을 추진한다는 계획이다.

이번 세미나에서는 이상수 가톨릭대 교수와 김원중 청주대 교수가 발제자로 나서 ‘탐정업의 효율적 관리와 운영을 위한 주요 쟁점과 입법방안’과 ‘주요외국 탐정법제의 현황을 통해 본 탐정업법 입법방향과 전략’을 발표한다.

또한, 경찰청·한국행정학회 경찰발전연구회 관계자를 비롯해서 김태완 변호사, 나영민 경찰수사연구원 교무과장, 이상원 용인대 교수, 이연욱 경찰청 수사지원계장, 최응렬 동국대 교수, 최진녕 대한변호사협회 공보위원장 등 탐정업과 관련된 각계의 전문가들이 한 자리에 모여 우리나라의 치안환경과 탐정업의 과제 및 향후 나아갈 방향 등 여러 가지 대책을 논의할 계획이다.

이번 세미나를 공동주최한 국민의힘 윤재옥 의원은 “탐정업은 일자리 창출이라는 現 정부의 핵심전략으로서, 빠른 시일 내에 국무조정실 주재 하에 경찰청과 법무부가 관리감독의 주체를 조정해야 한다.”고 지적하고 “이번 세미나를 계기로 우리 국민들의 사생활과 권익을 보호할 수 있는 실효성 있는 정책이 마련되기를 기대한다.”고 밝혔다.

This seminar was announced by the Moon Jae-in government's'plan to revitalize new jobs in preparation for the future industry and job structure' to select a certified detective business as one of 50 new jobs to solve the youth job problem. It is held to discuss legislation for the introduction of the detective business and ways to improve the effectiveness of the supervision of the detective business in line with the “Emergency Economy Central Countermeasure Headquarters Meeting”.

Although the public consensus and demand for the detective business has been high, detectives are not settled as a legal profession due to lack of laws and systems.

In fact, as a result of a public opinion poll conducted by the National Police Agency in April 2017 on the introduction of the accredited detective system, 72.3% of all respondents agreed to legislate detectives.

However, due to the issue of jurisdiction over where to direct and supervise the detective business, attempts to introduce the detective business over the past 15 years have been destroyed in the legislative process of the National Assembly.

In the meantime, voiceless private assistance projects such as “errand center” and “fact check agency” have become prosperous, and illegal and unfair investigations are continuing due to obsession with immoral requests and excessive performance.

The detective business system is not unique to Korea among OECD member countries, and detective activities are legally carried out in most developed countries. In the United States, the police in 15 states, the Ministry of Justice in one state, and a separate department in 21 states manage certified detectives. The Ministry of Interior in Britain and France, the police in Spain, and the Public Security Commission in Japan manage and supervise the certified detectives. In Korea, the demand for investigation services is also increasing explosively, but the demand cannot be met by the police alone.

Fortunately, during the presidential election, President Moon Jae-in pledged to “promote the introduction of a certified detective system that supports fact-finding.” Currently, the government is also pursuing it as a state-run project (May 2017), and in line with this, the introduction plan is also disclosed.

Currently, discussions between the Ministry of Justice and the National Police Agency practitioners are underway, centered on the State Affairs Coordination Office, and it is planned to promote the enactment of the Certified Detective Act by the first half of next year by designating departments under the jurisdiction of management and supervisory organizations.

In this seminar, Professor Lee Sang-soo of Catholic University and Professor Kim Won-joong of Cheongju University as presenters presented'Key Issues and Legislative Measures for Efficient Management and Operation of the Detective Business' and'The Detective Business Law Legislative Direction and Strategy based on the Current Status of Major Foreign Detective Legislation' do.

In addition, experts from various fields related to the detective business, including a person from the National Police Agency and the Korean Society for Public Administration, Tae-wan Kim, Young-min Na, Director of Police Investigation Research Institute, Professor Sang-won Lee, Yongin University Professor, Yeon-wook Lee, Prof. They plan to gather together to discuss various countermeasures, such as the security environment in Korea, the tasks of the detective industry, and the direction to go forward.

Rep. Yoon Jae-ok, who co-hosted this seminar, pointed out that "Detective business is the current government's core strategy of job creation, and as soon as possible, the police and the Ministry of Justice should coordinate the subject of supervision under the presence of the State Affairs Control Office."
