홍 의원에 따르면 코로나19 확산으로 외국인근로자는 취업활동 기간 만료에도 출국을 못하거나 재입국을 희망해도 입국금지로 제한을 받고, 입국 후에도 자가격리 시설 확보에 어려움을 겪고 있다.

해외입국자 가운데 확진자가 발생하고 있는 만큼 입국자에 대한 방역이 강화되는 것은 당연한 일이지만, 외국인근로자를 고용하고 있는 기업의 입장에서는 코로나19 확산으로 외국인력 확보에 어려움을 겪고 있다. 이로 인해 산업현장의 인력수급 애로가 심화되는 상황이다.

현행 외국인고용법은 외국인근로자가 입국한 날부터 3년의 범위에서 취업활동을 할 수 있고, 사용자가 고용노동부장관에게 재고용 허가를 요청한 근로자의 경우 2년 미만의 범위에서 취업활동 기간을 연장받을 수 있다.

하지만, 코로나19와 같은 감염병 확산으로 외국인근로자의 출·입국이 제한되는 상황에 대비한 예외적인 특별 규정은 없다. 이러한 입법적 미비를 개선해서 감염병 확산과 같은 특수한 상황에서는 외국인근로자의 취업활동 기간을 한시적으로 연장할 수 있도록 해야 한다는 지적이 제기되고 있다.

실제 대구상공회의소는 지난 12월 고용노동부에 감염병 등의 재난 상황으로 출입국이 어려운 경우 한시적으로 외국인근로자의 취업활동기간을 연장할 수 있도록 해달라고 건의했다.

홍석준 의원이 대표발의 한 법안은 감염병 확산 및 천재지변으로 외국인근로자의 출·입국이 어려운 경우 1년 미만의 범위에서 외국인근로자의 취업활동 기간을 연장받을 수 있도록 했다. 또한, 이러한 법개정이 법 시행 이전의 감염병 확산으로 출입국이 어려운 외국인근로자에 대해서도 소급적용되도록 했다.
