지난 23일 홍석준 의원이 대표발의한 「아동·청소년의 성보호에 관한 법률」 개정안이 국회 여성가족위원회 대안에 반영되어 국회 본회의를 통과했다.

현행법에는 아동·청소년을 성범죄로부터 보호하기 위해 아동·청소년을 일정 기간 보호 또는 직접 접촉 대면하거나 아동·청소년이 장시간 반복적으로 이용하는 여러 기관이나 시설에 성범죄 발생 사실 신고 의무를 부여하고, 성범죄로 유죄판결이 확정된 자의 등록정보 공개·고지제도와 취업제한 제도를 시행하고 있다.

특히 취업제한 대상에 의료기관도 포함되는데, 현행법은 의료기관에 취업이 제한되는 성범죄자를 의사 및 간호사 등 의료인으로 한정하고 있어, 비의료인은 성범죄 전과가 있어도 의료기관 취업에 제한을 받지 않고 있어 문제가 제기되어왔다.

의료기관에서 환자에 대한 비의료인의 성범죄가 계속 발생하고 있지만, 비의료인에 의한 성범죄 현황은 정확하게 파악조차 되지 않고 있어 의료기관 내 성범죄 예방을 위한 정책의 사각지대에 방치되고 있다는 지적 가운데 홍석준 의원은 이를 해결하기 위한 법안 마련에 나섰다.

홍 의원이 대표발의한 ‘아동·청소년의 성보호에 관한 법률 개정안’은 의료기관에 대한 성범죄자 취업제한 대상을 확대하여 아동ㆍ청소년을 비롯한 의료기관 이용 환자들을 잠재적 성범죄로부터 보호하는 것을 목적으로 한다.

해당 법안이 국회 본회의를 통과함에 따라 의료기관에 종사하는 의료인뿐만 아니라 간호조무사 및 의료기사까지 성범죄자의 의료기관 취업제한 대상 범위가 확대되어 아동·청소년을 보다 두텁게 보호할 수 있을 것으로 기대된다. 

홍석준 의원은 “아동·청소년을 비롯해서 의료기관에 입원한 환자는 보호자로부터 분리되어 있는 환경에 종종 노출되어 성범죄 피해의 위험도가 높은데도 불구하고 보호의 사각지대에 방치되고 있었다.”고 지적하며, “개정안이 통과된 만큼 성범죄자의 의료기관 취업을 보다 엄격히 제한하여 아동·청소년을 성범죄로부터 더욱 두텁게 보호해야 한다.”고 밝혔다.
