경상북도선거관리위원회는 13일 지방선거 후보자 선출을 위한 당내 경선과 관련해 경선선거인 등에게 금품을 제공하거나 수령한 자를 검찰에 고발했다고 밝혔다.

영덕군선거관리위원회에 따르면 ○○당 영덕군수선거 후보자 선출을 위한 당내경선에서 지난 5일과 6일 경 A씨 외 3명이 경선후보자 B씨를 도와달라고 하며 경선선거인 등에게 총 220만 원 상당의 현금을 제공하거나 수령한 혐의로 A씨 외 6명을 13일 대구지방검찰청 영덕지청에 고발했다고 밝혔다.

‘공직선거법’ 제57조의5(당원 등 매수금지)제1항에는 누구든지 당내경선에 있어 후보자로 선출되거나 되게 하거나 되지 못하게 할 목적으로 경선선거인 또는 그의 배우자나 직계존·비속에게 명목여하를 불문하고 금품 그 밖의 재산상의 이익 등을 제공하거나 그 제공의 의사를 표시하거나 그 제공을 약속하는 행위를 할 수 없고, 이를 위반한 자 및 그 이익을 제공받거나 그 제공의 의사를 표시한 자는 같은 법 제230조(매수 및 이해유도죄)제7항에 따라 ‘3년 이하의 징역 또는 1천만원 이하의 벌금에 처한다’고 되어있다. 

경북선관위는 “당내경선과 관련된 범죄는 공당의 당심을 왜곡해 정당한 후보자의 출마를 방해하고, 결국 선거 결과에 영향을 끼치는 선거범죄로서 선거일 이후라도 고발조치 하는 등 엄중하게 죄책을 물을 것이며, 공명한 선거를 실현하기 위해서는 지역 주민들의 적극적인 신고·제보가 필요하다”고 당부했다.

대구에서는 정당선거사무소 유급직원에게 선거운동을 시키고 대가를 제공한 캠프 측 관계자가 검찰에 고발됐다. 중구선관위에 따르면 A씨와 B씨는 공모하여 정당선거사무소에 유급직원 2명을 고용한 것으로 가장, SNS 등을 이용한 선거운동을 시키고 유급직원 인건비 명목으로 730만원을 지급한 혐의를 받고 있다.

대구시선관위는 법적으로 허용된 선거사무원 등이 아닌 자에게 선거운동을 시키고 그 대가를 지급하는 행위에 대해서는 선거가 종료된 후에도 후보자나 정당이 제출한 회계보고서를 면밀히 검토하여 위법여부를 확인·조사할 예정이라고 밝혔다. 

공직선거법에서는 선거사무원 등 공직선거법의 규정에 의하여 수당·실비 기타 이익을 제공하는 경우를 제외하고는 수당·실비 기타 자원봉사에 대한 보상 등 명목여하를 불문하고 누구든지 선거운동과 관련하여 금품 등을 제공할 수 없도록 규정하고 있다. 

수성구선거관리위원회는 본인의 예비후보자홍보물에 비정규학력을 게재해 선거구민에게 발송하고, 사전신고 없이 선거인에게 다량의 선거운동용 문자메시지를 전송한 예비후보자 A씨를 공직선거법 위반혐의로 검찰에 고발했다.

  수성구선관위에 따르면 A씨는 최종학력 외에 ‘○○대학교 □□대학원 00포럼 수료‘라는 비정규학력을 함께 게재한 예비후보자홍보물을 선거구민 총 493세대에 배부한 혐의가 있다. 또한, 사전 신고 없이 인터넷 문자 발송 사이트를 이용하여 선거인에게 자동 동보통신의 방법으로 8회에 걸쳐 총 1만1천582통의 문자메시지를 전송한 혐의도 있다.
