지난 16일 봉화선관위는 조합장 선거 출마자 A씨가 기부행위제한기간인 2022년 9월부터 2023년 2월 사이 조합원 13명에게 총 25만원 상당의 장갑을 제공한 혐의가 있어 봉화경찰서에 고발했다고 전했다.

 「공공단체등 위탁선거에 관한 법률」제35조(기부행위제한) 제1항에 따르면 ‘후보자(후보자가 되려는 사람 포함)는 기부행위제한기간 중 기부행위를 할 수 없다’고 규정하고 있고, 같은 법 제59조(기부행위의 금지·제한 등 위반죄)는 ‘제35조를 위반한 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다’고 규정하고 있다.

봉화군선관위 관계자는 “해당 고발건의 경찰 수사에서 A씨로부터 물품을 받은 것으로 추가 확인된 조합원 등에 대해 최고 50배의 과태료를 부과할 방침.”이라고 밝혔다.
