대구동구선거관리위원회는 본지와의 통화에서 배 후보 측의 ARS 발송이 단순한 경선 독려를 넘어 법적 테두리를 벗어났는지 면밀히 들여다보고 있다고 밝혔다.

선관위 관계자는 “배 후보 측이 보낸 ARS가 당원 외 일반 시민에게까지 무차별 발송되었는지, 그 규모와 고의성을 확인 중”이라며, 조사가 진행 중인 배경으로 “위반 여부를 인지하고  확인에 들어간 것”이라고 말했다. 배 예비후보는 앞서 선관위가 자신을 둘러싼 조사 등이 일절 없다는 답변을 듣고 확인했다“는 취지로 이에 대한 기사를 보도한 모 언론사 및 기자들을 고발했다고 긴급 자료를 언론에 배포했다. 

이에 대하여 본지가 해당 선관위에 ‘언론 보도와 관련된 내용’을 문의하자, 선관위는 ”조사라는 표현을 사용하기에는 부적절해 보인다“면서도 ”조사 단계는 아니더라도 배 후보가 발송한 ARS가 위법 내용이 있는지 없는지를 확인하고 있다. 확인하는 이유는 석연찮은 부분을 인지했기 때문“이라고 말했다. 위법한 사항에 대한 면밀한 조사단계는 아니어도 위반 혐의 정도를 발견 또는 인지하고 그 내용을 확인하는 조사 전(前)단계라는 것. 

‘조사 전 단계’는 큰 문제점이 발견되어 심각한 상황은 아니라는 점잖은 표현으로 행정적 배려의 표현일뿐, 선관위가 그냥 넘어가도 될 정도의 수위, 즉 면죄부는 아니다라고해석해야 한다고 전직 한 경찰 관계자는 설명했다. 

17일 정가 일각에서는 이번 상황을 두고 ”배 예비후보가 언론 고소라는 선택을 할 수밖에 없었던 그만한 상황이 있다 해도 쓸데없이 판을 키워 본인의 선거를 벼랑 끝으로 몰고 악재만 키운 꼴이 됐다“고 풀이했다.

In response to this, when this newspaper inquired with the relevant Election Commission regarding "content related to media reports," the Commission stated that "it appears inappropriate to use the term 'investigation'," but added, "Although it is not yet at the investigation stage, we are verifying whether the ARS messages sent by Candidate Bae contain any illegal content." "The reason for the verification is that we recognized some questionable aspects," he said. In other words, while it is not yet a stage for a thorough investigation into illegal matters, it is a pre-investigation stage where the extent of suspected violations has been discovered or recognized and the details are being verified.

The term "pre-investigation stage" is a polite expression indicating that no major issues have been discovered and the situation is not serious. It is merely an expression of administrative consideration; given that the severity is not such that the Election Commission can simply overlook it, it is not a free pass either.

On the 17th, some in political circles interpreted the situation by stating, "Even if there were circumstances that left Preliminary Candidate Bae with no choice but to sue the media, he has unnecessarily escalated the situation, driving his own election to the brink and only amplifying negative factors."
