「정치자금법」제45조 제1항에는 이 법에 정하지 아니한 방법으로 정치자금을 기부하거나 기부 받은 자(정당ㆍ후원회ㆍ법인 그 밖에 단체에 있어서는 그 구성원으로서 당해 위반행위를 한 자를 말함)는 5년 이하의 징역 또는 1천만 원 이하의 벌금에 처하도록 규정하고 있다.

선관위 관계자는 “후원회를 통하지 않는 방법으로 정치자금을 수수하는 행위는 선거질서를 훼손하는 중대범죄로서 엄중 조치할 것.”이라고 밝혔다.
