앞서 선관위는 국민의힘 경선 과정에서 모 후보를 허위사실 유포 혐의로 검찰에 고발했다. 선관위에 따르면 해당 후보는 자신의 과거 전과 사실을 해명하면서 사실과 부합하지 않는 내용으로 위장 및 포장해 미화시키는 방법으로 허위의 사실을 공표했다. 

선관위는 이번에는 같은 국민의힘 경선 예비후보자 B 씨와 캠프 관계자 C 씨 등 2명을 고발했다고 밝혔다.  A씨 등은 김천시장재선거 OO당 당내경선을 위한 여론조사 결과에 영향을 미치게 하기 위해 문자메시지 등을 이용, 다수의 선거구민에게 당원 여부를 거짓으로 응답하도록 지시․권유․유도한 것으로 알려졌다. 경북선관위는 이들을 최근 조사하고 관련한 혐의로 10일 김천경찰서에 고발했다.   

 ‘공직선거법’제108조제11항제1호와 제256조제1항제5호에서는‘누구든지 당내경선을 위한 여론조사 결과에 영향을 미치게하기 위해 다수의 선거구민을 대상으로 성별․연령 등을 거짓으로 응답하도록 지시․권유․유도하는 행위를 하여서는 아니되며, 이를 위반한 자는 3년 이하의 징역 또는 600만원 이하의 벌금에 처한다’고 규정하고 있다.
