【브레이크뉴스 포항】박영재 기자=김병욱 의원(국민의힘, 포항시남구울릉군)은 29일 대학법인의 경영 효율화를 위한 ‘사립학교법 일부개정법률안’을 발의했다고 밝혔다.
김 의원에 따르면 현행법은 대학법인이 기본재산을 처분하거나 자금 차입 등을 하려면 교육부의 허가를 받도록 하되, 경미한 사항의 경우에는 교육부에 신고하도록 하고 있다. 또 대학법인이 정관을 변경하려면 이사회의 의결을 거쳐 교육부장관에게 보고하도록 정하고 있다.
이에 따라 대학법인이 학교경영의 효율을 높이기 위해 수시로 기본재산을 처분, 정관변경을 할 때마다 교육부가 사전 검토를 하고 있다. 정량적‧절차적 요건만 갖추면 승인 등이 이루어져야 하는 경미한 사안의 경우에도 교육부장관의 신고 수리를 받거나 사전 판단을 받아야 한다.
이 때문에 대학법인의 신고 및 보고 사항에 대해 교육부가 사전 검토하는 기간이 길어지면서, 학교의 자율적인 의사 결정이 지연된다는 문제점이 제기되고 있다.
이에 김병욱 의원은 대학법인의 기본재산 처분 등과 관련한 경미한 사항에 대한 신고 수리와 정관변경 보고 접수 등을 ‘한국사학진흥재단법’에 따른 한국사학진흥재단에 위탁하는 내용의 조항을 신설했다.
김병욱 의원은 “개정안을 통해 대학법인의 의사 결정이 신속하게 이루어져 학교경영의 효율성이 높아질 것으로 기대한다”고 말했다.
