 【브레이크뉴스 경북】이성현 기자=의정활동 업무와 관련된 사안으로 소송에 휘말렸다면 의회 차원에서 관련 소송비를 지원한다는 내용의 지원 조례가 제정됐다. 

경북도의회 최병근 의원(김천, 국민의힘)은 제359회 제2차 정례회에서 도의회 소속 의원과 직원의 적극적인 의정활동 및 직무수행 환경을 조성하기 위해‘경상북도의회 의원 등의 소송비용 지원 조례안’을 대표 발의했다고 밝혔다.

경북도의회에 따르면 최근 지방의회 의원과 직원들이 의정활동 및 직무수행 과정에서 민·형사상 소송에 휘말리는 사례가 증가하고 있는 것으로 알려졌다. 전국 17개 광역시도 집행부에서는 모두 공무원 소송비용을 지원하고 있지만, 의회 차원에서 의원과 직원의 소송비용을 지원하는 곳은 인천광역시의회 등 6개 의회에 불과한 것으로 나타났다.

특히 경상북도의회는 22개 시군과 연계된 광역의회로서 다양한 현안에 대한 의정활동과 감사·조사 업무를 수행하고 있어 법적 분쟁에 노출될 가능성이 높음에도 불구하고, 소송비용 부담으로 인해 소극적인 의정활동과 직무수행을 할 수밖에 없어 이에 대한 제도적 보완이 시급한 상황으로 알려졌다. 

따라서 이번 조례안에는 의원과 직원의 소송비용 지원을 위한 체계적인 기준과 절차 외에 민사소송 피고 및 형사사건 수사·기소 시 소송비용을 지원한다는 내용과 민사 소송목적 가액에 따라 200만 원~1천만 원, 형사사건은 수사 단계 및 심급별 각 1천만 원 지원내용이 포함됐다. 다만, 한국지방재정공제회 지원과 중복지원을 금지하고 고의·중과실 패소 및 유죄 판결 시에는 환수하는 내용도 담았다. 특히, 지원 논의단계서부터 외부 전문가로 구성된 심의위원회가 해당 사안을 심의하고 결정한다는 등의 내용을 담고 있다.

이 과정에서 아무래도 가장 중요한 역할을 하는 기구는 심의위다. 박 의원은 소송비용 지원의 공정성과 투명성을 확보하기 위해 ▸소송실무 경험이 있는 변호사 ▸의정 및 법률분야 전문가 등으로 구성된 외부 심의위원회를 운영하도록 했다. 

특히, 적극적 의정활동 또는 직무수행 과정에서 기소유예, 선고유예, 집행유예 처분을 받은 경우에도 소송비용 지원을 신청할 수 있도록 하여 공익을 위한 적극 행정을 장려하였고, 현재 진행 중인 사건뿐만 아니라 조례 시행 전 6개월 이내에 무혐의 처분 또는 무죄 판결을 받아 종결된 사건에 대해서도 소급 적용할 수 있도록 하여 부당하게 소송비용을 부담한 의원 등의 권익을 보호하고자 하였다.

최병근 의원은 “집행부 공무원들은 직무 관련 소송에 대해 소송비용을 지원받고 있지만, 정작 주민의 대표기관인 지방의회 의원과 직원들은 이러한 보호 장치가 마련되어 있지 않아 소송비용 부담으로 소극적인 의정활동을 할 수밖에 없는 실정”이라며“이번 조례 제정을 통해 의원과 직원이 소송비용 걱정 없이 적극적으로 의정활동과 직무를 수행할 수 있는 환경이 조성되기를 기대한다”고 밝혔다.

 이번 조례안은 11월 21일 경북도의회 의회운영위원회 심사를 통과했으며 오는 12월 10일 3차 본회의에서 최종 의결될 예정이다.

 A support ordinance has been enacted to provide legal assistance at the council level for those embroiled in litigation related to their legislative activities.

Gyeongsangbuk-do Provincial Council Member Choi Byeong-geun (Gimcheon, People Power Party) announced that he had proposed the "Ordinance on Support for Litigation Costs for Gyeongsangbuk-do Provincial Council Members" at the 2nd regular session of the 359th session to foster an environment in which provincial council members and staff actively engage in legislative activities and perform their duties.

According to the Gyeongsangbuk-do Provincial Council, there has been a recent increase in cases of local council members and staff being embroiled in civil and criminal litigation in the course of their legislative activities and duties. While all 17 metropolitan and provincial executives nationwide provide legal assistance for civil servants, only six councils, including the Incheon Metropolitan City Council, provide legal assistance at the council level for their members and staff.

The Gyeongsangbuk-do Provincial Council, a regional council linked to 22 cities and counties, conducts legislative activities and audits and investigations on a wide range of issues. Despite this, the council is highly exposed to legal disputes. However, the burden of litigation costs has forced council members to engage in passive legislative activities and perform their duties. This has led to an urgent need for institutional improvements.

Therefore, this ordinance, in addition to establishing systematic standards and procedures for supporting the legal expenses of council members and staff, includes provisions for supporting litigation costs for defendants in civil lawsuits and for investigations and prosecutions in criminal cases. The ordinance provides for support ranging from 2 million to 10 million won, depending on the subject matter of the civil lawsuit, and 10 million won for each stage of the investigation and the level of the criminal case. However, it also prohibits overlapping support with the Korea Local Finance Corporation and provides for recovery of funds in cases of intentional or gross negligence, loss, or conviction. Notably, the ordinance stipulates that a review committee comprised of external experts will review and decide on relevant cases from the initial support discussion stage.

The most crucial body in this process is undoubtedly the Review Committee. To ensure fairness and transparency in the provision of legal aid, Representative Park established an external review committee comprised of: attorneys with litigation experience; and experts in legislative and legal fields.

In particular, by allowing applications for legal aid for those who received suspended indictment, suspended sentencing, or suspended sentences during active legislative activities or the performance of their duties, the ordinance was made available to encourage proactive public administration. Furthermore, the ordinance was retroactively applied to cases concluded within six months prior to its implementation, including those not guilty or found not guilty, to protect the rights of lawmakers who unfairly incur legal costs.

Councilman Choi Byeong-geun stated, "While executive officials receive legal expenses support for job-related lawsuits, local council members and staff, who represent the residents, lack such protections. Consequently, they are forced to engage in passive legislative activities due to the burden of legal fees." He added, "I hope that the enactment of this ordinance will create an environment where council members and staff can actively perform their legislative activities and duties without worrying about legal fees."

This ordinance passed the Gyeongbuk Provincial Council's Steering Committee review on November 21 and is scheduled for final approval at the third plenary session on December 10.
