시의회는 24일 열린 제324회 제1차 정례회 제2차 본회의에서 '포항시 공익소송 비용지원에 관한 조례안'과 '포항 촉발지진 정신적 피해 손해배상 소송 판결에 대한 촉구 결의안'을 의결했다.

먼저 의결된 '포항시 공익소송 비용지원에 관한 조례안'은 공익적 성격의 소송을 지원할 수 있는 법적 근거를 마련하는 내용을 담고 있다. 조례에는 공익소송 비용 지원 대상과 방법, 공익소송심의위원회 구성 및 운영, 소송 결과 제출 의무 등이 명시됐다. 특히 조례 시행 당시 진행 중인 소송에도 적용할 수 있도록 규정해 현재 진행 중인 대법원 상고심 소송 당사자들의 비용 부담을 실질적으로 덜어줄 것으로 기대된다.

이어 시의회는 '포항 촉발지진 정신적 피해 손해배상 소송 판결에 대한 촉구 결의안'을 채택했다. 결의안은 대법원이 정부의 책임을 회피하지 말고 피해 주민들의 고통을 외면하지 않는 공정하고 정의로운 판결을 내려줄 것을 촉구하는 내용을 담았다.

또한 시의회는 1·2심 법원이 지열발전사업과 촉발지진의 인과관계를 인정한 점을 강조하며 정부의 공식 사과와 피해자에 대한 실질적인 정신적 피해 구제 대책 마련을 요구했다. 아울러 무리한 국책사업으로 인한 인재가 반복되지 않도록 실효성 있는 재발 방지 대책 수립도 강하게 촉구했다.

앞서 시의회는 지난 11일 김일만 의장을 비롯해 이강덕 포항시장, 김정재·이상휘 국회의원과 함께 대법원을 방문, 정의로운 판결을 요청하는 호소문을 전달하는 등 지역 정치권과 시민사회, 법률전문가들과의 협력을 통해 총력 대응을 이어가고 있다.

The city council then adopted a “Resolution Urging a Ruling on the Pohang Earthquake Mental Damage Compensation Lawsuit.” The resolution included content urging the Supreme Court to make a fair and just ruling that does not avoid the government’s responsibility and does not ignore the suffering of the affected residents.
