앞서 경찰은 대중교통전용지구 중앙로네거리∼반월당네거리 왕복 2개 차로 가운데 1개 차로에서만 집회를 열 수 있다는 내용을 대구퀴어문화축제 조직위에 통고했다.

이에 조직위는 지난 19일 대구 중부경찰서장을 상대로 옥외집회 금지 통고처분 취소 집행정지 신청을 냈다.

그러나 법원은 “이 사건 처분의 효력을 정지할 긴급한 필요가 있다고 인정하기 부족하고 오히려 효력이 정지될 경우 공공복리에 중대한 영향을 줄 우려가 있다”고 판단했다.
