대구시는 ‘2024 대구퀴어축제 관련 대구광역시 입장’을 통해 집회 장소 변경을 요구했다. 지난해 열린 축제에서 대구시와 갈등을 빚었던 경찰 역시 올해는 대중교통전용지구 중앙로네거리∼반월당네거리 왕복 2개 차로 가운데 1개 차로에서만 집회를 열 수 있다는 내용을 대구퀴어문화축제위원회에 통고했다.

이 같은 압박에도 대구퀴어문화축제조직위위원회는 “경찰의 제한통고서를 수령하지 않았다”며 “집회 신고 된 대로 진행하겠다”는 입장을 밝혔다.

이 가운데 정의당 대구시는 “대구퀴어문화축제는 지난해까지 6년 동안 대중교통전용지구 2개 차로에서 개최되었고 아무런 문제가 없었다”며 대구시와 경찰에 결정을 비판하고 나섰다.

이들은 “대구시는 경찰에 집회가 금지 또는 제한될 수 있는 조처를 해달라고 밝혔다”며 “집회에 대한 신고, 금지, 제한통고 등은 대구시의 권한이 아니다. 월권이다”고 표현했다.

또한 경찰이 집회 제한을 통고한 것에 대해 “집회 참가자도 원활한 축제를 열 수 없고 대중교통을 이용하는 시민이나 보행자들은 불편을 겪을 수밖에 없다”며 질타했다.

그러면서 “대구시와 경찰의 결정은 언뜻 정당한 것 같지만 실제 정당하지 않다”며 “집회는 허가제가 아니라 신고제”라고 강조했다.

법원은 도로 점용허가로 퀴어문화축제 행사 진행을 막은 대구시의 대응이 부당하며 700만 원을 배상하라는 판결을 내린 바 있다.

정의당 대구시당은 “집회와 시위에 대한 금지 또는 제한통고는 상당히 제한적으로 행해져야 한다”며 “그렇지 않으면 헌법이 보장하고 있는 시민의 집회·시위 자유는 크게 훼손될 수밖에 없다”고 덧붙였다.
