【브레이크뉴스 대구】진예솔 기자=정의당 대구시당은 대구 경찰이 제17회 대구퀴어문화축제에 대해 집회제한통고를 내린 것에 대해 "헌법상 집회의 자유를 침해한 조치"라며 강력히 반발하고 나섰다.

15일 정의당은 성명을 통해 “집회의 자유에 ‘허가’는 필요 없고 ‘신고’로 충분하다”며 경찰 조치를 비판했다. 

경찰은 축제 주최측이 신고한 전체 2개 차선 중 1개 차로만 사용하도록 제한했으며, 이는 작년에 이어 두 번째 집회 제한 조치다.

정의당은 이번 제한이 축제 진행을 온전히 보장할 수 없으며, 시민 불편과 참여자 안전을 심각하게 위협한다고 지적했다.

실제로 대구퀴어문화축제는 2018년부터 2023년까지 6년간 대중교통전용지구 2개 차로에서 진행됐지만 문제 없이 운영됐다.

헌법 근거도 제시했다. 정의당은 “헌법 제21조 제2항은 집회·결사에 대한 허가는 인정되지 않는다”며 “모든 국민의 집회와 시위 자유를 원칙적으로 보장한다”고 강조했다.

또한 홍준표 전 시장 시절 발생한 집회 자유 침해 사례를 거론하며 “대구 경찰과 법원은 과거의 잘못을 답습하지 말아야 한다”고 경고했다. 

이어 경찰에는 “헌법 가치를 수호하고 민주주의와 인권을 지켜야 할 경찰은 즉각 집회제한통고를 철회하라”고 요구했다.

한편, 대구퀴어문화축제 조직위원회는 경찰의 통고를 거부하고 법원에 집행정지 가처분을 신청한 상태다. 

정의당은 법원을 향해서도 집회 시 발생할 수 있는 소음과 통행 불편은 일반 시민도 수용해야 한다는 대법원 판례를 근거로 “헌법 가치를 훼손한 경찰 통고에 대해 집행정지 가처분을 인용하라”고 촉구했다.

Meanwhile, the Daegu Queer Culture Festival Organizing Committee has rejected the police notice and has filed a court injunction to suspend its enforcement.
