27일 헌법재판소는 최상목 대통령 권한대행이 마은혁 후보자를 헌법재판관으로 임명하지 않은 것에 대해 국회에 대한 권한 침해라는 결정을 내렸다.

이에 진보당 대구시당은 “너무나 당연하고 상식적인 판단”이라며 “내란과 민주주의 사이에 중립은 없다”며 이같이 밝혔다. 

이들은 “최상목 권한대행이 내란과 민주주의 사이에 중립은 없습니다. 기계적 중립을 자처하는 태도도 내란 엄호일 뿐”이라며 “헌법재판소의 지엄한 최종 판단에도 법무부·법제처와 추가 검토 등 씨알도 안 먹힐 궤변을 다시 들고 나온다면 스스로 '위헌범'임을 자복하는 것”이라고 주장했다.

그러면서 “최상목 권한대행은 지체 없이, 즉각 마은혁 헌법재판관을 임명해야 한다”며 “민주주의를 지키는 국민의 이름으로 강력하게 명령 한다”고 덧붙였다.

He added, “Acting President Choi Sang-mok must immediately appoint Justice Ma Eun-hyeok of the Constitutional Court without delay,” and “I strongly order this in the name of the people who protect democracy.”
