지방선거를 앞두고 입후보예정자가 인지도를 높이거나 지지기반을 확대하기 위해 명절 인사를 명목으로 금품을 제공하는 사례가 발생할 우려가 커짐에 따라, 경북선관위는 도 및 구·시·군선관위와 함께 입후보예정자와 정당, 지방자치단체장, 지방의회의원 등 관련 기관·단체를 대상으로 안내자료 배부와 방문·면담 등 특별 예방·안내활동을 적극 전개할 계획이다.

경북선관위는 '공직선거법'에 따라 명절선물이나 식사 등을 제공한 사람뿐만 아니라 이를 받은 사람에게도 제공받은 금액의 10배 이상 50배 이하에 해당하는 과태료가 부과될 수 있다며 유권자의 각별한 주의를 당부했다.

실제 과태료가 부과된 사례로는 지방자치단체장 명의의 명절선물(3만 원 상당 홍삼세트 등)을 제공받은 선거구민 901명에게 총 5억9,408만 원의 과태료가 부과된 경우를 비롯해, 지방의회의원 명의의 명절선물(2만 원 상당 한라봉)을 받은 78명에게 총 1,680만 원, 국회의원 보좌관 명의의 명절선물(4만 원 상당 곶감)을 받은 124명에게 총 2,960만 원의 과태료가 부과된 사례 등이 있다.

아울러 각 정당의 후보자 공천 절차가 본격화될 것으로 예상되는 가운데, 당내 경선이 단속 대상이 되지 않는다는 잘못된 인식을 경계해야 한다고 강조했다. '공직선거법'과 '정치자금법'에 따라 특정인을 후보자로 추천하는 과정에서 금품이나 재산상 이익을 제공하거나 받는 행위, 정치자금을 기부하거나 수수하는 행위는 엄격히 금지된다.

처벌 사례로는 입후보예정자가 공직후보자 추천관리위원인 국회의원에게 공천헌금 명목으로 7천만 원을 제공해 징역 1년을 선고받은 경우와, 비례대표 후보자 공천을 위해 공천심사위원과 전 당대표에게 불법 정치자금을 제공해 징역 1년 6월에 집행유예 2년을 선고받은 사례 등이 있다.

또한 당내경선 여론조사와 관련해 성별·연령 등을 거짓으로 응답하도록 유도하거나, 착신 전환 등을 통해 동일인이 중복 응답하는 행위 역시 금지된다. 과거 선거에서는 이러한 행위로 징역형이나 벌금형이 선고된 바 있다.

경북선관위는 명절 인사 명목의 선물 제공이나 후보자 추천과 관련한 금품 수수 등 위법행위가 적발될 경우 철저한 조사와 함께 법과 원칙에 따라 엄중 조치할 방침이다. 명절 연휴 기간에도 비상연락체제를 유지하며, 위법행위 발견 시 국번 없이 1390번으로 즉시 신고·제보해 줄 것을 당부했다.

한편, 위법행위 신고자는 법에 따라 신원이 철저히 보호되며, 중요한 기여가 인정될 경우 포상금심사위원회의 의결을 거쳐 최고 5억 원의 포상금이 지급된다.
