안동시의회는 최근 축제 기간 성추행 의혹을 받은 시의원을 일사분란하게 제명했다. 반면, 구미시의회는 공무원을 폭행한 혐의를 받는 안 모 의원에 대해 출석정지 30일이라는 솜방만이 처벌로 지역민들로부터 빈축을 사고 있다.

급기야 공무원 노조가 들고 일어났다. 구미시공무원 노조는 21일 성명서를 내고 “시민대표 기관이 스스로 공직윤리를 포기했다”고 의회를 비판했다.

안동시의회는 지난 17일 제261회 임시회 본회의에서 윤리특별위원회가 상정한 제명안을 표결해 가결했다. 재적 의원 18명 중 16명이 참석해 이 가운데 찬성 14표로 가결됐다.

해당 시의원은 지난달 열린 ‘안동국제탈춤페스티벌’ 행사 중 해외 공연단 미성년 단원을 성추행했다는 의혹을 받아오면서 경찰 수사 대상이 됐다.  

안동시의회는 “공직자의 품위는 타협할 수 없다”는 입장을 공식화하며, 지방의회가 시민 신뢰 위에 세워져야 한다는 원칙을 강조했다. 특히, 이 사례는 안동시의회 개원 이래 첫 제명이었다는 점에서 지방의회의 자정능력·책임성을 보여주는 상징적 조치로 평가받고 있다. 

반면, 구미시의회는 상황이 다르게 전개되고 있어 지역민들의 눈살을 찌푸리게 하고 있다. 구미시의회 안 모 의원은 지난 5 월 23일, 구미시 인동시장에서 열린 ‘달달한 낭만 야시장’ 개장식에서 축사 순서가 배정되지 않은 것에 불만을 품고 시의회 공무원 A씨에게 욕설을 하고 뺨을 때리는 등 폭행 사건을 일으켰다.

사건 이후 구미시공무원노조 및 경북공무원노동조합연맹 등이 해당 의원 제명 및 향후 공천 배제 등을 강력히 요구했다. 실제, 지난 6월 9일 비공개로 열린 윤리위원회 회의에서 구미시의회는 민간위원이 포함된 윤리심사자문위 의견을 받아 안 의원 제명을 의결했다. 그러나 6 월 23일 본회의에서 제명 안건은 부결되고, 대신 출석정지 30일 징계가 결정되면서 안 의원은 의원직을 유지하게 됐다. 

사건 이후 시의회 앞에는 근조화환이 놓였다. 전국 공무원노조차 “제 식구 감싸기”라며 규탄하고 나섰다. 

구미시의회 대응, 무엇이 문제인가

구미시의회의 대응을 두고 지역사회가 여전히 분노하고 있다. 시민들은 어떤 상황에서도 폭력은 안된다는 점을 강조하면서 “누구보다 모범을 보여야할 구미시의회 의원들이 폭력행위에 대하여 경시하는 경향을 보이고 있다”고 우려했다.

이들은 “공무원은 시민을 위해 일하는 공적 직업이며, 그 직무집행 중에 폭행당했다는 것은 단순한 말실수가 아닌 형법상 공무집행방해죄에 해당할 수 있다”고 분개하며 “제명이 의결되고도 본회의에서 이를 뒤집은 과정은 폭력을 저지른 의원에게 의원직 유지라는 면죄부를 주었다”고 비판했다.

시민들은 안동시의회의 원칙적이고도 단호한 결정과 비교하고 나섰다. 형평성 차원에도 맞지 않는다는 비난이 쇄도했다. 이들은 “안동시의회가 외국인 공연단 미성년자를 성추행한 혐의를 받는 시의원에 대해 즉각 제명이라는 강한 조치를 취한 것과 달리, 구미시의회는 제명을 위한 절차를 밟고도 결국 제명을 거부했다”며 “이러한 대비는 ‘정치의 책임성’이라는 측면에서 구미시의회의 몰염치함을 그대로 보여주는 것”이라고 주장했다.

특히, 구미시의회의 행보는 공직윤리와 시민 신뢰를 크게 훼손했다는 비난에 직면하고 있다. 

구미시공무원 노조는 “시민이 위임한 권한을 행사하는 의회가 구성원 스스로 윤리적 책임을 다하지 않으면, 그 기관 전체의 신뢰가 흔들릴 수밖에 없다”며 “시민의 대표기관이 공직윤리를 포기하고 정치적 계산과 이해관계를 앞세웠다”고 강하게 비판했다.

노조는 “폭행 피해 공무원은 여전히 상처 속에 있고, 구미시 공직사회는 깊은 분노와 허탈감에 빠져 있다”며 “반성은커녕 사태를 축소하려는 태도를 보이는 해당 의원의 즉각적인 사퇴와 의회의 대시민 사과, 나아가 흔들린 공직윤리 정립과 재발 방지를 위한 대책을 마련할 것” 을 촉구했다.

On May 23, at the opening ceremony of the "Sweet Romantic Night Market" held at Gumi's Indong Market, a Gumi City Council member, surnamed Ahn, verbally abused and slapped a city council official, A, in response to being denied a speaking slot.

Following the incident, the Gumi City Government Employees' Union and the Gyeongbuk Government Employees' Union strongly demanded the expulsion of the council member and his exclusion from future nominations. Indeed, at a closed-door Ethics Committee meeting on June 9, the Gumi City Council voted to expel Ahn, after consulting with the Ethics Review Advisory Committee, which includes civilian members. However, at a plenary session on June 23, the expulsion motion was rejected. Instead, a 30-day suspension was imposed, allowing Ahn to retain his seat.

Following the incident, a wreath of condolence flowers was laid in front of the city council. Even the National Public Service Workers' Union condemned the incident, saying it was "protecting its own members."

The local community remains angry over the Gumi City Council's response. Citizens emphasized that violence is unacceptable under any circumstances, and expressed concern that "Gumi City Council members, who should be setting an example, are showing a tendency to downplay violent acts."

They expressed their indignation, stating, "Public officials are public servants, working for the citizens. Being assaulted while performing their duties is not a simple slip of the tongue; it could constitute obstruction of official duties under the criminal law." They criticized, "The process of overturning the expulsion vote at the plenary session gave the violent councilor a free pass by retaining his seat."

Citizens contrasted this decision with the Andong City Council's principled and firm decision. Criticism poured in, arguing that this decision was unfair. They argued, "Unlike the Andong City Council, which took the strong step of immediately expelling a council member accused of sexually harassing a minor from a foreign performing arts troupe, the Gumi City Council ultimately refused to expel him despite pursuing expulsion procedures. This contrast clearly demonstrates the Gumi City Council's shamelessness in terms of 'political accountability.'"

In particular, the Gumi City Council's actions are facing criticism for severely damaging public ethics and public trust.

The Gumi City Government Employees' Union strongly criticized the council, stating, "If the council, which exercises the authority delegated by the citizens, fails to fulfill its ethical responsibilities, the trust in the entire institution will inevitably be shaken."
