해경에 따르면, 해상에서 불법 포획된 고래고기를 선박을 이용해 은닉·운반한다는 첩보를 입수하고 수사를 진행해왔다. 포항 입항 직전, A호 어창에서 고래고기 165자루(약 1.8톤 상당, 밍크고래 2마리 추정)를 적발하고 현장에서 전량 압수했다. 해당 고래고기의 시장 가치는 약 2억3,000만 원에 달한다.
포항해경은 압수한 고래고기에 대해 DNA 채취 및 분석을 진행해 고래의 정확한 종과 개체 수를 확인할 예정이다.
밍크고래는 해양포유류로서 보호종에 해당되며, 이를 불법으로 포획할 경우 「수산업법」과 「해양생태계의 보전 및 관리에 관한 법률」 위반으로 3년 이하 징역 또는 3,000만원 이하의 벌금에 처해진다. 또한, 포획된 고래를 소지하거나 보관, 유통, 판매하는 경우에도 「수산자원관리법」 위반으로 2년 이하 징역 또는 2,000만원 이하의 벌금이 부과된다.
