임 교육감은 지난 2018년 지방선거에 경북교육감으로 처음 출마해 공무원에게 선거운동 대가를 대납하게 하는 등의 혐의로 기소, 1심에서 징역 2년 6월을 선고받았다. 그러나 2심에서 재판부는 수사 과정에서 확보한 증거 가운데 일부가 위법하게 수집됐다고 판단, 무죄를 선고했다. 25일 열린 대법원의 쟁점 역시 이 증거가 위법한 것인지에 대한 것이었으나 대법원은 2심의 손을 들어 줬다. 

임 교육감이 무죄를 선고받기는 했으나, 증거 수집의 위법성에 의한 무죄 취지가 결정적 이유였던 만큼 실제 죄가 없다는 취지는 아닐 것이라는 게 지역사회 일반적 시각이다. 따라서 어떤 선거보다 윤리적, 도덕성이 중요시되는 교육감 선거임을 감안하면 내년 지방선거에서도 이같은 사안이 논쟁이 쟁점이 될 가능성이 농후해졌다. 

다만, 임 교육감이 무죄를 확정함에 따라 그동안 경북교육감 선거 출마를 저울질해 왔던 인사들의 행보에 관심이 쏠릴 전망이다. 이제까지 경북교유감 출마 예상자로는 김성조 전 경북문화관광공사 사장을 포함해 지난 선거에 출마했던 임준희 문명고 교장, 그리고 양금희 경상북도 경제부지사 등의 이름이 거론되어 왔다.

The Supreme Court on the 25th acquitted Gyeongbuk Superintendent of Education Lim Jong-sik of charges including bribery under the Aggravated Punishment, etc. of Specific Crimes Act and violation of the Education Autonomy Act.

Lim first ran for the position in the 2018 local elections. He was indicted on charges of having a public official pay campaign expenses on his behalf. He was sentenced to two years and six months in prison in the first trial. However, in the second trial, the court ruled that some of the evidence obtained during the investigation had been illegally collected, and acquitted him. The Supreme Court's decision on the 25th also focused on whether this evidence was illegal, but the court sided with the second trial.

While Lim was acquitted, the general public view is that this does not mean he is actually innocent, as the acquittal based on the illegality of the evidence collection was the decisive factor. Therefore, given that the superintendent election places a higher priority on ethics and morality than any other election, this issue is likely to become a contentious issue in next year's local elections.

However, with Superintendent Lim's acquittal confirmed, attention is expected to turn to the moves of those who have been weighing a run for the Gyeongbuk Superintendent of Education election. Previously, potential candidates for the position included Kim Seong-jo, former president of the Gyeongbuk Culture and Tourism Organization; Lim Jun-hee, principal of Munmyeong High School who ran in the previous election; and Yang Geum-hee, vice governor for economic affairs of Gyeongsangbuk-do.
