현직 임종식 교육감은 최근까지 재판을 받아왔다. 2018년 선거 과정에서 제기된 뇌물 및 선거운동 자금 대납 의혹에 대해 1심에서는 징역형을 받았지만 2심에서 무죄가 나왔고, 지난 9월 대법원 역시 무죄를 최종 확정했다.

그럼에도, 여전히 교육청 내부·외부에서는 “증거물 수집 과정의 절차적 문제로 무죄가 확정된 것뿐, 도덕성 논란이 완전히 사라진 것은 아니다”라는 시선이 남아 있다. 단순히 ‘죄가 없다’는 법적 판단을 ‘완전한 청정’으로 직결시키기는 어렵다는 의견도 많다.

따라서 교육감 후보들과 유권자들이 이 ‘사법 리스크’를 얼마나 정치 쟁점으로 살릴지, 그리고 또 얼마나 덮고 가는지에 따라 내년 경북교육감 선거 판도는 달라질 전망이다. 실제 대구경북권 교육계 관계자들은 “내년 있을 경북교육감 선거는 단순히 ‘누가 이기느냐’ 이상의 의미를 가진 선거”라고 분석했다.
