지난 29일 임종득 의원은 국가안보를 보다 튼튼히 하기 위해 ‘군형법 일부개정법률안’을 대표발의했다고 밝혔다.
현행법에 따르면 적을 위해 간첩행위를 한 사람을 간첩죄로 처벌하고 있으나, 외국을 위해 간첩행위를 하거나 외국에 군사기밀을 누설하는 경우는 국가안보에 치명적인 위해를 가할 수 있는 중대범죄임에도 불구하고 간첩죄로 처벌할 수 있는 근거가 없는 실정이다.
현행 군형법에도 누설죄가 있으나 간첩죄에 비해 법정형이 낮아, 누설의 상대방이 외국인인 경우 그 범죄의 중대성에 비추어 가중 처벌할 필요성이 제기되고 있는 상황이다.
또한 군사기밀보호법에도 군사기밀의 탐지·수집행위 및 누설행위를 처벌하는 조항이 있으나 법정형이 낮거나 ‘업무상 군사기밀을 취급하는 사람’ 등으로 그 행위주체를 한정하고 있어 개선할 필요성이 있다. 실제로 미국, 독일, 중국 등 주요 국가의 경우 간첩죄에 ‘외국’ 등을 명시해 처벌하고 있다.
임종득 의원은 “이번 개정안이 통과된다면 국가안보를 보다 더 철저히 할 수 있을 것으로 본다”며 “국민과 국가를 위해 조속한 법안통과를 기대한다”고 밝혔다.
