대구시는 공무원 골프대회 지원금 내역 등 관련 자료를 비공개해 헌법상 알 권리를 침해했다는 법원의 판결에 따라, 언론사 '뉴스민' 기자에게 110만 원의 손해배상금을 지급했다. 

그러나 대구경실련이 지난해 9월, 국민신문고를 통해 이와 관련된 공무원 구상권 행사 및 소송비용 회수 여부를 질의하자, 대구시는 “고의나 중대한 과실이 아니다”라며 별도의 조치를 하지 않겠다고 공식 답변했다.

이에 대해 대구시는 “2024년 직원동호회 지원계획은 2023년과 달라 정보공개 의무 판단이 어려웠다”며 “공무원이 주의는 부족했으나 중대한 과실이나 고의는 아니라고 판단했다”고 해명했다.

하지만 대구경실련은 “대구시는 법원과 중앙행정심판위원회의 판단마저 부정하며 스스로 행정 신뢰를 무너뜨리고 있다”고 비판하면서, “이미 같은 사안에 대해 반복적으로 유사한 판결과 재결이 나왔음에도 여전히 ‘판단 미숙’으로 책임을 회피하는 것은 명백한 행정 퇴행”이라고 지적했다.

대구경실련은 특히 홍준표 전 대구시장 취임 이후 직원동호회 지원계획 관련 정보가 비공개로 전환된 점에 주목했다. “기존에 공개하던 정보를 시장 취임 이후 돌연 비공개로 전환한 것은 행정의 자의적 판단이자 시민 위에 군림하는 행태”라면서, “시민 세금으로 운영되는 대구시의 본질을 망각하는 것”이라고 비판했다.

또 “비공개 결정이 개별 공무원의 자율적인 판단이 아니라 상부의 지시나 압력에서 비롯된 것으로 보인다”며, “그럼에도 시가 내부 책임자 감싸기에만 급급한 모습은 스스로 부당한 지시를 인정하는 꼴”이라고 지적했다.

대구경실련은 이번 사안을 대구시의회 2025년 행정사무감사 제보 과제로 제출하는 한편, 대구시에 '소송사무 처리 규칙'에 따라 구상권 청구와 소송비용 회수 절차 이행도 촉구했다. 만약 대구시의회가 관련 대응에 미온적으로 나설 경우, 공익감사청구 등 추가 조치도 불사할 방침이다.

대구경실련 관계자는 “시민 세금으로 지급된 손해배상금과 소송비용을 손놓고 방치하는 것은 행정 책임을 포기하는 것”이라고 지적하며, “대구시는 잘못된 관행을 바로잡고, 의도적 정보 비공개의 배경과 책임자를 반드시 밝혀야 한다”고 강조했다.

아울러 “시민의 알 권리는 행정의 기본이며, 반복적인 침해는 민주주의 근간을 흔드는 일”이라며 “끝까지 진상 규명을 추진하겠다”고 덧붙였다.

The Daegu Citizens' Coalition for Economic Justice specifically noted that information related to the employee club support plan was made confidential after former Daegu Mayor Hong Joon-pyo took office. They criticized the decision, stating, "The sudden decision to make previously public information confidential after the mayor's inauguration is an arbitrary administrative decision and an act of lording it over the citizens. It is a loss of control over the fundamental nature of Daegu City, which is funded by taxpayer money."

They also pointed out that "the decision to not disclose the information appears to have stemmed not from the independent judgment of individual public officials, but from orders or pressure from higher-ups." They added, "The city government's focus on protecting its internal officers is tantamount to admitting to the improper order."

Daegu Citizens' Coalition for Economic Justice submitted this matter to the Daegu City Council for its 2025 administrative audit and urged the city to implement procedures for claiming indemnity and recovering litigation costs in accordance with the "Litigation Processing Rules." If the Daegu City Council remains lukewarm in its response, the organization plans to take additional measures, including filing a public interest audit.

A Daegu Citizens' Coalition official stated, "Ignoring damages and litigation costs paid with taxpayer money amounts to an abdication of administrative responsibility." They emphasized, "Daegu City must rectify this wrongful practice and uncover the background and culpability behind the intentional information disclosure."

He also said, “Citizens’ right to know is the foundation of administration, and repeated violations shake the foundation of democracy,” adding, “We will pursue the truth until the end.”
