대구경실련의정감시단에 따르면 의무적으로 설치 운영해야 하는 윤리심사위원회를 구성한 곳은 대구시의회와  달서구의회 두 곳 뿐으로 나타났다.

또, 의원행동강령조례(윤리강령 및 행동강령조례)의 행동강령자문위원회를 구성한 곳은 대구시의회와 서구의회 두 곳으로 나타났다. 중구·동구·남구·북구·수성구·달서구·달성군의회는 조례 제정 후 행동자문위원회를 아예 구성조차 하지 않은 것으로 이번 조사에서 밝혀졌다.

다만, 의원 해외연수를 심사하는 공무국외출장심사위원회는 대구지역의 모든 지방의회가 구성, 운영했다. 

2022년 1월 13일부터 시행되고 있는 지방자치법 전부개정안에 따르면 모든 지방의회는 윤리심사자문위원회를 설치, 운영해야 한다. 윤리심사자문위원회는 ‘지방의회의원의 겸직 및 영리행위 등에 관한 지방의회의 의장의 자문과 지방의회의원의 윤리강령과 윤리실천규범 준수 여부 및 징계에 관한 윤리특별위원회의 자문에 응하는’ 위원회로 전원 외부인사로 구성한다. 

대구시의회 등 대구지역 지방의회는 모두 ‘공정한 업무수행(사적 이해관계의 신고, 예산의 목적외 사용금지, 수의계약 체결제한, 인사청탁 금지)’ 등 지방의회 의원이 준수하여야 할 행동기준과 위반 행위의 신고 및 확인, 위반 시의 조치 등을 주요내용으로 하는 지방의회 의원 행동강령 조례(윤리강령 및 행동강령 조례)를 제정, 운영하고 있다. 이 역시 전원 외부인사로 구성해 견제와 감시 기능을 강화해왔다.

이 위원회는 ▶의원의 행동강령 위반 행위에 대한 신고의 접수 및 조사·처리에 관한 사항, ▶의원이 다른 기관·단체로부터 여비·활동비 등을 지원받아 직무와 관련된 국내외 활동의 승인에 관한 사항, ▶의원에 대한 행동강령의 교육 및 상담에 관한 사항, ▶조례의 준수 여부에 대한 점검에 관한 사항 등에 대한 자문 기능 등을 수행한다. 

그러나 대구경실련이 정보공개청구를 통해 확인한 바에 따르면 대구지역 지방의회 중 행동강령자문위원회를 구성, 운영한 의회는 대구시의회와 서구의회가 유일했다. 서구의회 이외의 기초의회는 조례 제정 이후 행동강령운영자문위원회를 아예 구성조차 하지 않은 것으로 나타났다. 대구시의회의 경우, 7대 의회는 위원회를 구성하고 회의를 2차례 하였지만 8대 의회는 구성만 하고 회의는 하지 않았다. 

지방의회의원의 해외연수의 타당성과 적합성 등을 심사하는 공무국외출장심사위원회의 구성과 운영은 상대적으로 훨씬 활발한 편으로 나타났다. 이 위원회 구성시에는 2/3이상이 외부인으로 채워져야 한다. 

공무국외출장심사위원회는 해외 출장의 필요성 및 출장자의 적합성, 출장국과 출장기관의 타당성, 출장기간의 타당성 및 출장경비의 적정성 등을 심사하는데 본회의 또는 위원회의 의결에 의하며 공무로 국외출장(해외연수) 시 반드시 심사를 받아야 한다.
