달서구의회 김귀화 의원이 정자금법을 위반 혐의로 벌금 500만 원을 선고 받아 의원직 유지여부가 불투명해졌다.

대구지법 서부지원 제2형사단독 김정우 부장판사는 마을기업 소유 차량 2대를 무상으로 기부 받아 개인 용도로 사용해 정치 자금법을 위반한 혐의로 지난해 4월 불구속 기소된 김귀화 달서구의원에게 당선무효형에 해당하는 벌금 500만원을 선고했다고 11일 밝혔다.

김귀화 의원은  마을기업 대표로부터 기업 소유의 승용차 한 대를 무상으로 제공받아 이 차를 약 2년 이상 구의회 출퇴근 등 의정 활동에 사용하였으며 이후 차량이 낡아 사용이 어렵게 되자 또 다른 승용차 한 대를 무상으로 제공받아 정치자금법을 위반한 혐의로 재판에 넘겨졌다.

이에 김귀화 의원에 대해 김정우 부장판사는 “마을기업이 사업을 위해 받은 국고보조금으로 취득한 재산이므로 마땅히 그 사업을 위하여 사용되어야 함에도 피고인이 개인 정치활동을 위해 사용했다는 점에서 비난 가능성이 크다”면서 “피고인이 범행을 부인하면서 잘못을 반성하지 않고 있는 데다 유사 전력도 있다”고 지적했다.

그러면서도 “사용한 승용차들 연식이 오래된 노후 차량으로 기부 받은 이익이 크다고 볼 수 없는 점을 참작했다”고 양형이유를 밝혔다.

이와 함께 김정우 부장판사는 김귀화 의원에게 차량을 무상으로 제공하여 보조금 관리에 관한 법률 위반 등 혐의로 기소된 마을기업 대표 A씨에게는 벌금 200만원을 선고했다.
