대구고법 형사2부(부장판사 정승규)는 전직 군청 공무원 A 씨(63)가 건설업자 B 씨(54)로부터 공사 수주 등의 대가로 2000만 원을 받아 김 군수에게 전달했다는 진술에 신빙성이 떨어진다고 보고 “뇌물죄 협의가 합리적인 의심 없이 입증되었다고 보기 힘들다“는 1심 판결을 그대로 인정, 특정범죄가중처벌등에 관한 법률 위반(뇌물수수) 혐의로 기소된 김주수 군수에 대한 검사의 항소를 기각했다. 

다만, 재판부는 제3자 뇌물취득 혐의로 함께 기소됐던 전직 군청 공무원 A 씨에게는 징역 8개월과 추징금 2000만 원을 선고하고 법정구속했으며, 뇌물공여 혐의로 기소된 건설업자 B 씨는 징역 4개월에 집행유예 2년을 선고했다.

항소가 기각되면서 검찰의 명분이 사그라진 이상 이 사건이 대법원까지 가는 것은 무리가 있다는 지적에 따라 김 군수에 대한 전체 혐의는 일단락될 것이란 전망이다.
