사건의 발단이 된 것은 지난달 15일 대구 중구의회 김효린,이경숙 의원이  중구도심재생문화재단 사무실을 방문해 2022년 하반기 회계서류 일체 제출을 요구하면서다.

두 의원의 자료 요구 직후 공무원 노조 측은 이를 '갑질 행위'라며 성명서를 내고 해당 의원과 의장의 공개사과 등을 중구의회에 요구했다.

이에 대구 중구의회 김오성 의장은 지방자치법상 지방의회 폐회 중에는 의장이 서류 제출을 요구할 수 있고, 의장을 통해 요청해야 했는데, 이를 무시하고 재단을 찾아가 자료를 요구한 김효린 의원, 이경숙 의원에 대한 윤리특별위원회 회부 및 징계 요구의 건을 구의회에 제출했다.

김오성 중구의회 의장은 "노조 측에서 징계 요구가 올라왔고 윤리위에 회부해 판단을 하는 것이 맞다고 생각했다."며" 사실관계나 징계 수위는 본회의 결정에 따라 판단할 것"이라고 밝혔다.

중구도심재생문화재단 관계자는 "폐회 중에는 지방의회 의장만이 서류 제출을 요구할 수 있다는 법규를 잘 몰랐다. 일반적으로 자료를 요구할때는 구청이나 담당과를 거치는 절차를 밟아 서류를 요구해왔다.“며 ”이렇게 압수수색하듯이 서류를 내놓으라고 하는 경우는 대구 8개구군 뿐만 아니라, 다른 곳 어디에도 없을 것"이라고 입장을 밝혔다.

또한 “심지어 어떤 이유로 서류를 요구하는지에 대해서 설명 조차 듣지 못했다."라고 설명했지만 사건의 당사자인 두 의원의 입장은 다르다.

김효린 의원은 "제 284회 임시회 제 1차 본회의 회기 중, 지난 2월 도심재생문화재단의 업무보고에서 자료가 부족해 당시 업무보고를 한 상임이사에게 추후 자료를 요청해도 되겠냐고 먼저 양해를 구하고 방문 한 것"이라며 "지방자치법과 지방의회운영가이드북의 지침을 준수한 지방의원의 적법한 업무였다."고 설명했다.

그러면서 "과거에는 단 한번의 문제도 없었던 의원의 정상적인 업무가 왜 '갑질의원'이라는 수식어로 둔갑을 하는지 이해가 되지 않는다.“고 덧붙였다.

이 가운데 성명서를 내고 의원들의 징계를 요구했던 노조측은 두 의원이 윤리위 회부가 되자 ”지나간일이 더이상 기사화 되는것을 원치 않는다며 성명서 이외에는 입장이 없다.“고 답변했다.

한편 윤리위 회부 절차는 오는 13일 예정된 제285회 중구의회 임시회 본회의에서 해당 안건이 상정된다.

전체 중구의원 7명이 참석한 가운데 과반수가 찬성하면 시민단체와 변호사 등으로 꾸려진 윤리위 자문위원단에 회부되고, 자문단이 사실관계를 파악 후 이들의 징계 수위를 판단한다.

이후 구의원들로 구성된 윤리위가 최종적으로 징계 수위가 결정한다.  지방의회 의원에 대한 징계는 공개회의에서의 경고 또는 사과, 30일 이내의 출석 정지, 제명으로 나뉜다.
