14일 대구지법 행정1부(채정선 부장판사), 행정2부(신헌석 부장판사)는 대형마트 의무휴업일 변경고시 집행정지 신청을 기각했다고 밝혔다.

재판부는 “고시에 따라 바뀌는 것은 대형마트 의무휴업의 요일일뿐이지 해당 근로자의 근로일수와 근무시간이 변경되는 것은 아니며 노사 자율에 따라 단체협약, 근로계약 등을 통해 해당 근로자의 근무일수, 휴무일 등이 정해지기 때문에 이 사건 고시로 해당 근로자들의 일요일 휴무가 완전히 차단된다고 인정하기 어렵다."며 "신청인들에게 회복하기 어려운 손해가 발생할 우려가 있다거나 그 손해를 예방하기 위해 고시의 효력을 정지할 긴급할 필요가 있다고 인정하기 부족하다”고 설명했다.

앞서 마트노조는 지난달 대구시와 각 구·군이 월 2회 대형마트 의무휴업일을 일요일에서 월요일로 바꾼다고 고시하자 효력을 정지해달라며 대형마트나 관련노조가 없는 남구, 중구, 달성군을 제외한 5개구를 상대로 고시 처분 취소 소송과 집행정지 신청을 함께 냈다.
