16일 권 의원은 TK 신공항 토지보상을 적기에 할 수 있도록 하는 ‘공익사업을 위한 토지 등의 취득 및 보상에 관한 법률’ 개정안을 대표 발의했다고 밝혔다.

대구시는 TK신공항 기존 개항 예정 시기인 2030년보다 1년을 앞당긴 2029년에 조기 개항하는 것을 목표로 사업에 박차를 가하고 있다.

사업의 정상적인 추진을 위해서는 적기에 토지보상과 수용이 이루어져야 하는 것이 선결과제인데 토지 관련 특례조항을 포함하고 있는 현재의 TK신공항 특별법 개정안이 통과되더라도 실제 토지보상에 있어서 법적인 효력이 없어 관련 대책이 필요한 상황이다.

현행 토지보상법에 따르면 공익사업의 토지와 관련된 특례조항은 토지보상법 이외의 개별법에서는 정할 수 없도록 규정되어 있으며, 그 결과 TK신공항 특별법은 특별법이라 할지라도 토지보상법 개정 없이는 토지보상에 대한 법률적인 근거 규정이 될 수 없다.

이에 권영진 의원은 국토교통부와 긴밀한 협의를 통해 토지 등을 수용하거나 사용할 수 있는 공익사업에 TK신공항 건설사업을 추가하는 내용의 토지보상법 개정안을 대표 발의 했다.

권 의원은 “이번에 발의한 토지보상법 개정안과 함께 현재 국토위에 계류 중인 TK신공항 특별법 개정안도 조속히 통과시켜 관련 사업이 차질 없이 추진될 수 있도록 혼신의 힘을 다하겠다”고 강조했다.

In order to normally promote the project, timely compensation and expropriation of land are a prerequisite, but even if the current revision of the TK New Airport Special Act, which includes special provisions related to land, is passed, it will not have legal effect in terms of actual land compensation, so related measures are needed.

According to the current Land Compensation Act, special provisions related to land for public projects cannot be established in individual laws other than the Land Compensation Act, and as a result, even if the TK New Airport Special Act is a special law, it cannot serve as a legal basis for land compensation without revising the Land Compensation Act.

Accordingly, Rep. Kwon Young-jin, in close consultation with the Ministry of Land, Infrastructure and Transport, proposed a revision to the Land Compensation Act that would add the TK New Airport construction project to public projects that can acquire or use land, etc.

Rep. Kwon emphasized, “Along with the Land Compensation Act revision proposed this time, I will do my utmost to ensure that the revision to the TK New Airport Special Act currently pending in the Land, Infrastructure and Transport Committee is passed as soon as possible so that the related projects can proceed without a hitch.”
